Employer keeps phoning when i'm off sick

    They have a duty to keep in contact and let you know what is going on in the work place so you are up to date when you go back and to ask how you are, to offer you any support you may need, but once a week should suffice and DEFINATELY not to ask you to do stuff for them or ask you when you are going back! you are off sick for a reason with a doctors certificate (one presumes?) to say you are unfit to work.

    I would contact the manager and express your thanks for their concern but that their calls are quite disruptive to your recovery as they keep waking you up/disturbing you. Agree a time and day that they chould ring and ask them to respect that. Failing that, take your phone off the hook.

    I believe that this would come under harassment, and you can certainly follow this line in a grievance if you wanted to.
    However, if you can , ask them to stop as Morty said (nice line about the effecting my recovery!) , and then add this is harassment if they continue. I know that this is difficult to do, but you need to nip this in the bud now, or else you will have many troubles ahead!

    I would ask them the question "how would you cope if I left the company?" Maybe they should use this opportunity to train others in areas you have responsibility for.

    As long as you are supplying sick notes they cannot keep phoning you, nor can they demand you contact them. The sick note covers for that.

    if you are signed of sick you are not seen as fit to work, they are not to call you to discuss work related issues as you are deemed as un-fit to work.

    They can, however, call you to ensure that you are doing ok, but this should be kept to a minium, this is more of a coutiousy call from your manager to you, once a week or so just to make sure you are ok

    It is unacceptable for them to call you about work and you must tell them so.

    Just a moral human duty. Nothing legal, but you will find that most HR departments have written into their sick policys that managers keep in touch with their staff to make sure they get any support they need in order to return to work. Sorry, I thought I made that clear in my inital response.

    I was off sick for a long time when i was employed and we had certain rules we had to go by but the way your place of work is behaving is disgraceful, and i would nip this in the bud before it carries on any further. They have no right whatsoever to treat you in this manner. If you are sending in your sicknotes then i would write to them and arrange with someone in charge say a manager or personnel to call out to your home at a time which suits you both and they can ask how you are and if they can offer you any support. They will ask when you think you will be able to come back to work. Then tell them at this visit, that you wish for these upsetting calls to stop immediately and they can write to you say once a month to ask how you are, and you will not be allowing this harrassment to carry on. If you feel like some support at the home visit, ask a friend or family member can they sit in the room with you. This is what i did while i was at work, and it was for a large retail firm, and they never rang and rang me like that. I wish you well and hope you are better soon. Please let me know how you get on. Keep a copy of any correspondance. Please start the ball rolling today if possible and take back control. These people are really out of order. Take care of yourself, and all the very best to you.

    All the above posters are absolutely correct - you need to politely ask them to stop calling you as you are signed off by the doctor.

    If it continues after you have asked them to stop, then that would be the point at which you raise a grievance.
