Holiday pay as a Bank Staff Worker

Hello all,

I currently work in a Nursing Home on the 'bank staff'. I am about to be given a one year contract to cover maternity leave.

The person at work who gives me my hours etc happened to say that "it isn't fair as I'm doing lots of hours yet missing out on holiday pay" So she thinks its fair to give me a contract :T

My letter of employment as a bank worker states Holidays in line with Working Time Regulations 1998

In my verbal induction with the deputy manager at the start of my employment as bank said "That although we don't get paid if we don't work, we do get a payment 3 times a year pro-rata to the hours we have worked as holiday pay. If we want to know when the next payment will be we simply ask the wages person"
"The holiday payment would be shown as an amount on our wages slips."

I have been working for about 39 hrs per week since the beginning of November, this dropped to 23 hrs about a month ago (my choice).

Now I havn't spent the holiday pay so to speak I am just wondering if I am still entitled to holiday pay for the duration from November to when I am contracted.

    Yes you are due to be paid for holiday accrued on bank. Normally in the NHS it is paid as a separate amount each time you are paid (on the basis that you are not working full-time and therefore you can take holiday during the same month as you work). It shows as a separate amount.

    You presumably work in the private sector and therefore they are delaying paying you to pay it in three tranches. As your contract is changing, you should receive the amount accrued up to the point of your revised contract.

    If you have a 1 year contract then you are entitled to a minimum of 5.6 weeks paid holiday, this can't be rolled up and paid to you, it must be paid when you take holidays.

    Oh, sorry no, perhaps I didn't make myself clear :o From November until now I have been employed as bank staff.

    Shortly I will be given a 1 year contract to cover maternity leave. Then I know I will get paid holidays, that isn't in question.

    What is in question is the period from November to now when I have been on bank staff.

    anamenottaken, yes you are correct I do work in the private sector rather than NHS and it was explained to me exactly as you have said.

    If it's paid 3 times a year, and you started in November, then I'd have expected a payment by now. Not necessarily in Feb: when we had bank staff I did everything a month in arrears, so I'd work out holiday pay due (say) to the end of Feb and get it paid in March.

    Ask when you're due to be paid it!
