Legal Aid Question.

I had to take my ex partner to court to gain access to my daughter in 2010 and she had legal aid funding.

She is being non complaint with the contact order and I am considering court action again if she continues to fail to comply.

With the changes in legal aid for family cases will she still recieve aid on an existing funding mandate or have ALL family law cases been cut?

I dont know the answer but why worry? If she isnt complying with the order then take it back to court. Dont leave it to long so that your relationship with your child suffers. If she gets legal aid or not shouldnt make a difference to your case.

If the case completed, her legal aid would have been closed and therefore she won't get funding off the back of that.

All family law has been taken out of the scope of legal aid except where certain conditions are met concerning domestic abuse or where is a child is considered to be at risk. Within those exceptions, there are clear definitions of what qualifies AND it has to be backed up with evidence. She would also still be subject to means testing.

It would be a new application for a breach anyway, so she would not be covered...
