Finance / Loan on Caravan advice
Options
Hi I am hoping someone can help me,
My partner brought a static caravan holiday home in 2007, this was through Barclays partner finance.
My partners uncle had been paying this all off - my partner had taken the credit as uncle was unable to get it due to bad credit history (silly I know he was only 18).
In 2009 uncle stopped paying finance, he also sold the caravan. We found this out a few months ago due to having debt collectors knocking at the door, uncle now wont accept calls etc for several months which is annoying as we just wish he has told us he couldnt afford it or what reason instead of ignoring it and blacklisting Oh's name.
I know as the credit is in partners name its his responsibility but we are wondering how he managed to sell the caravan without partner's permission/signature etc.
We have been told to find out if the caravan was on finance as it would have been tied to loan. We do not have original paperwork but on a statment it says Barclays Partner Finance with Bunn Leisure.
OH said the money never went into his account it went straight to Bunn Leisure - if it was a loan would the money had to have gone into his account or could it have gone straight to the company?
We have rung Bunn lesiure asking for some details - they said it was a loan not on finance (despite when I rang to enquire another man said it would have been on finance - this was before they knew what it concerned), they wont tell us who's name the caravan was in or who it was sold to - but they could tell us how much it sold for and that it was a trade seller not a private seller.
Am I right in thinking they are somewhat trying to cover their backs as they have not taken the proper checks to ensure it was the owner selling the caravan? We are assuming the trade buyer would have been them - this would have been the simplest for OH uncle to do.
Surely even if OH had got money as a loan and then brought the caravan with it it would still be in his name - all the passes etc for the park he was the one who authorised it all if that makes sense and his uncle was a secondary pass holder.
His uncle paid off a small lump sum but not all of the money he got for the sale of the caravan so he has kept some to himself and now OH is left with over 10k of debt! The finance was also for 10 years! I cannot beleive he was so stupid to do it in the first place! But his uncle had been making repayments for 2 years all fine.
I know Oh is still going to be left with a big loan but we are wondering if there is anyway we can claim back the money for the caravan?
If anyone can give us any help we would be really grateful as we are worrying so much about this and we dont have lots of money spare at the end of the month as we are a young family.
