Absolutely - the law is very clear on this. The Equality Act covers someone who has ... or who HAS HAD cancer. So even if the cancer was some time ago and there are no on going health problems or current treatment, that person is still covered. This means that an employer cannot decide to withdraw a job offer because they are concerned that there is a risk that the cancer may come back and cause the person to be unreliable in the future. It also means that the employer must make reasonable adjustments to its working practices, for example to allow the employee to attend hospital follow up appointments without being penalised under the absence procedures.
