parking 'ticket' please help

Ok in brief, My Wife was in a lot of pain, so I rushed her the 25 miles to my local A+E upon arrival I even had the thought to buy a parking ticket, but I only had a p;ound so bought one for an hour, well after a LONG examination, pain injections and an X ray I rememebred the parking, as I didnt have any more money I asked my Wife, the injections now taking the pain away , if she had any, she produced a 2 pound coin, I then l;eft her while I went and purchased a ticket for all day, when I got to my car I had been given a ticket !! Ok so I emaild TPS Totalparkingsolutions for 6 days on the tro without reply, and on the same day as the ticket, when I arrived home I put in an appeal on their website. I got a robotreply aboput hopw they had recived my appeal and would look into it. NO replies whatsoever to me Emails. This all happened on the 28th of Feb. Today I get a reply !! can I give them more details and proof etc. There is NO photo on the website, they dont have one obviousley, they have not addressed my letter, no one has even 'signed' the email they sent and I have heard nothing of any substance about my appeal which I put in on the 28th of Feb ( today being 27th of Mrach) . Been told to swallow it and pay but I feel it is not only unfair but a damn disgrace. I bought a ticket and indeed I bought two tickets, the most I was 'out of ticket' for was appox an hour while I saw to my Wife. What should I do ?

Ignore, which you should have done from the start. 5 or 6 snotty letters threatening court, increased penalties, bailifs, the spanish inquisition (you didn't expect that did you), excomunication, defenstration etc. Then they will sod off and try some other victim and you will never hear about it again.The truth may be out there, but the lies are inside your head. If your forum surname is your real surname, any unwanted visitor is likely to think twice before coming on to your land :rotfl:
Bailiffs can only attend should this be taken to court, you get a judgement against you and you fail to pay within the 28 days timeframe. Virtually nil prospect.
Relax and ignore (but retain) what might drop through your letterbox from this outfit from here on in - unless real court papers. In that highly unlikely event - come back here for further advice.Please note, we are not a legal advice forum. from the issue of the parking charge notice (in whatever
format you send it) to allow the driver, keeper or hirer to
challenge the enforcement action.
22.8 You must acknowledge or reply to the challenge within
14 days of receiving it. If at first you only acknowledge
the challenge, you must accept or reject the challenge in
writing within 35 days of receiving it. We may require you
to show that you are keeping to these targets.
Seems they didn't.
I would write back, quoting the above and tell them that under their Association's Code of Practice, they have failed to adhere to the required timescale and that you now consider the matter timed out.0 -

Not sure which uninformed and naive, scam-swallowing nitwit has told you to pay! Sorry if it was a friend or relative but they are WRONG.
It's NOT a real parking ticket at all, private parking tickets which impersonate real 'PCNs' (same acronym but without the word 'penalty') are a well-known con in Hospital, retail, supermarket, cinema, railway (indeed any private car parks) and the scam has already exposed by Watchdog loads of times:

It's an old thread but a good summary of the position.
No private parking company (PPC) can actually issue a real fine or penalty on private land, such as hospital or retail car parks, etc. Nor can they affect your credit rating nor send a bailiff round without the small matter of winning a Small Claim in Court first! And that won't happen.
The most that will happen is more junk mail letters over the coming months (the fake piece of paper impersonating a parking ticket was the first link in the chain of this con). But the letters are from debt collectors which can scare naive people. So you may be better off appealing further and in a stronger vein.
Please read the current forum and also show your family and friends so they also learn about this scam. Spread the word like we do! Just to be clear, we are NOT saying not to pay a fair Pay and Display fee nor do we ever condone selfish parking (in your case I know neither apply anyway).

Similar scam, impersonating authority and playing on some people's naivety. But not you because you are here now and can spread the word now you know the truth. Tell your friends & family never to pay a fake PCN.
But just to add, I would send them some evidence of the Hospital visit, point out any breaches of the BPA Code of Practice (look it up on the BPA website and note the breaches regarding the signs, the ticket and the time period for reply) and demand a POPLA code to take the appeal further to the independent stage (at their expense and without it being binding on you, only them!). Did their letter mention POPLA, did the fake PCn mention POPLA at all? It should unless this was in Scotland. Read the forum about POPLA, it's mentioned on almost every thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have had nothing at all in writing, do emails count ? I got one to aknowledge that I made an appeal, it was obvioulsey just a automated email, the first I heard from them in reply to anything I sent was 27th of March, looks to me like they have a system where they answer thigs just before the dead line. Are Emails sufficient proof ? as I say I have nothing at all in writing, no letters etc. Like I guess a lot of people I am a little worried it could escalate and cost me more in the long run and some friends do say pay it.0 -

Confused, !! some say ignore some say pay and some say do a stonger letter of appeal. I have had no letters at all, only one email on 27th of March asking for more proof of my appeal, I guess the two tickets I bought and because I did think about I , I also got the X ray dept to give me a date stamped 'verification' piece of paper to show I was actually there, of course the medical records of my Wife will also show I was there and why. So should I send copies of these ? if I do and they havent got my address already am I not passing it on to them ? They havent mentioned anything about POPLA etc because they havent written to me and as I say even the one and only email while just withong the 35 days isnt even signed so I have no idea who I am dealing with.

Regrettably, the automatically generated acknowledgement in your previous post followed by the one mentioned here means they are within time.
I would do as coupon-mad suggests in the last paragraph. Send them the proof they ask for and in that letter tell them that you hope they will allow your appeal but if not then please send POPLA code.
In the meantime, check all their signs agree with the BPA code of practice.0 -

No-one says pay, your friends are completely wrong about that! :eek:
There is no definitive answer because there are now 2 choices whereas we used to just say 'ignore it'.
Your choices are to ignore, which loads of us have done over the years quite happily - I have ignored 2 fake PCNs and all the debt collector letters myself but I ignored everything from the outset - or appeal using POPLA.
So as you have already appealed and did not ignore it from the outset, I would recommend continuing with that if this was in England/Wales only. Because you could win at POPLA stage at their expense and because it's a reasonable thing to do (you've started so you finish the appeal). So play their little game and send them a reply, see if they then give you a POPLA code.
If they do, or don't, then come back and tell us either way as there are ways of winning this, as shown in this pepipoo thread of discussion:

If you read all that thread over the weekend you'll see all the informed discussion going on about the 'appeal or ignore?' current question.
Specifically look at Broadsword's replies - he is the expert and he has set out what has happened to appeals to another PPC (PE) where sometimes they issue a POPLA code and sometimes they don't - either way you can win but don't just fire off any old POPLA appeal, it needs work and advice from here or pepipoo!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
