Council Tax Banding Appeal!

Hi All.

I have put in an appeal against the decision on my council tax banding.My appeal at the VO is June 12 07.
I am renting a 1 bedroom flat and my banding is a band B when I beleive it should be an A
.According to the letter from the Listing Officer..My banding is correct based on there evidence of actual sales of dwellings in the locality at the Valuation date of 1 April 1991.Then they go on to say from there records it would appear that my property is larger than the 2 flats below me?(this was an old victorian terrace house now made into 3 flats).
...and therefore they are unable to reduce my banding?

I have looked at Martins website and from what I can see the banding on the VO for my street varies? so am confused...According to the VO site my flat is a B,and the 2 flats below are a B and D? yet they say my flat is bigger and yet the flat at band D is very tiny as I viewed it before I decided on this flat?
So ok I have a kitchen,living room,bedroom and bathroom and very small hallway and store cupboard.The living room and bedrrom are a good size due to it having high ceilings being a victorian house.

Sorry to baffel on but looking on Martins website i didnt know whether to price the property as a flat or house for 1991 figures coz i dont know what it was then but I know these 3 flats have been here 5yrs or more? My landlord has given me council tax bills for all her properties based on the same size flat and they are all Band A's...can I use these as evidence for the appeal and martins figures as evidence.

I am so angry i know so many people living in 2&3bedroom houses and on a banding A yet they say the size of my flat should be a B compared to these houses???? :confused:
