CIFAS Marker

Hi everyone

I'm new to this site and was wondering if anyone can help me.

I applied for a mortgage with the Leeds Building So, cat 4ciety through a broker last year. The broker asked me for my ID, bank statements etc, said i had been accepted in principle and took some money from me.

The mortgage got declined and he said it was just due to the recession and bad time to apply. So i gave up and walked away.

Next ting i know i had my bank account closed by barclays, couldnt obtain any credit or insurance and was advised to check my credit report, which i did and it is perfect, nothing adverse on there. So after further investigation via google i sent off a SAR request to Cifas, and had a reply stating i have a marker filed by leeds for false proof of income (CAT 4 marker).

Does anyone know how i can get this removed, and or how long it will stay on for? I have tried contacting the leeds but im getting nowhere and in despearate need of help or advice.

    Make a SAR to National Hunter as well. You may need to do both.

    Do you know if the broker was directly authorised by the FSA, or a member of a network?

    It may be worth contacting the firm, or the network to see what was submitted and how this happened.

    Thanks for that, ill submit one to them as well. The broker seems to have dissapeared now. He's closed and gone underground

    Establish if the firm was directly regulated by the FSA or by a network by checking here. You need to establish what was disclosed to the lender;-

    You should have got a KFI before you applied for the mortgage, that should have the broker details and also the network that he is a member off (or was)

    Ok ill check that.

    And the CIFAS marker says 'false proof of income, bank check and proven to be false/altered statements'

    Might be worth while making a subject Access Reject to Leeds to see what information they hold on you and copies of the submitted forms.

    Sounds like the submitted details have been altered and the broker has been caught. Might be worth while seeing if any other customers of this broker have had the same thing.

    Please establish if the broker was DA (directly authorised by FSA) or AR (appointed representative of a network) before you do anything else. If AR, you can chuck this at the Network's compliance department and ask them to investigate for you.

    If he was directly authorised, you're going to have to do this yourself, although you can complain to the FSA afterwards.

    I will investigate whether they were regulated, thanks alot.

    Also, does anyone know when this marker will be removed, is there a time frame?

    If the marker is erroneous then suggest you contact both the lender and NationalHunter to have your record corrected.

    CIFAS acts as a warning to other financial providers, and firms must have firm basis, before recording any CIFAS warning on a data subject.

    To have the entry removed/amended, you would firstly need to contact the provider and in a nutshell ... provide sufficient evidence for them to establish that the inaccurate info provided re your declared income, was made without your direct input, knowledge or direction, but as an independent and standalone action of the broker - thereby distancing you and proving your innocence from the fraudulent activity.

    Without going into the whys and wherefore's of how this will be investigated, contact Leeds with your complaint and take it fro there ...
