halifax!!!

hi,
i am in the process of repaying my credit card debts with a token amount each month, most of the companies have agreed to set this up for the short term but halifax say i cannot do it on my own and have to go through a debt managment company, therefore they cannot accept the offer. has anyone else had this problem?
also BARCLAYCARD. the other company not helping ,has passed my account over to a company called Mercer, who say they are a debt collecting agency i have offered them an amount of 10 pounds a month but they say they want 180!!. does this mean bailiffs?? im very concerned now.

    Bailliffs need a court order to gain entry. They won't get a court order if you are paying as much as you reasonably can. If you make them an offer that is in line with that accepted by other creditors and it is reasonable and you stick to it then the chances of them taking you to court are very small. It is esentially a try on to get you to pay them preferentially over your more helpful creditors.

    I don't have personal experience of Halifax or Barclaycard but I can say that bailiffs do not get involved unless the debt is taken to court.

    However, other folk here have had problems with both Halifax and Mercers. Both are heavy handed merchants.

    Whatever these organisations say, they cannot seize goods. Mercers are actually a nasty nasty company who are actually part of Barclaycard! - do a search on their name on the DFW forum and you will see posts like below:

    General consensus from posts is to continue making your payments - they can't take you to court when you are doing this.

    If they start hassling you on the phone, send a registered letter requesting that your phone number is removed from their database and that they only communicate with you via letter. Look at the payplan web site for advice relating to harassment from debt collection agencies.

    yes i have sent halifax a letter along with my personal finance statement as i did with all the other companies i will send it again.

    Make sure you send all mail by recorded delivery won't you! Also quote that you have repeatedly suggested an offer payment that they have unreasonably refused and that any Court would take a dim view of such an unreasonable refusal and to bear in mind that. On National Debtline they have some draft letters, one being letter K it's a good one if you are being threatened with court action. It works too, the second time.

    Thank them for their letter dated..... I am very disappointed that we seem unable to reach a satisfactory compromise in this case. As I have already explained I can only afford £.... per month at the present time. This is the only realistic payment proposal bearing in mind the enclosed Personal budget sheet.

    You have stated in correspondence your intention to commence proceedings in the county court against me. The commencement of legal proceedings under such circumstances could be counter to the ' Overriding Objectives' of the Civil Procedure Rules. You will be aware that the 'Overriding Objectives underpin everything the court does. Moreover, paragraph 4 of the Protocols Practice Direction states that in the cases not covered by an approved pre- action protocols, the court will expect the parties "to act reasonably...in trying to avoid the necessity for the start of proceedings."

    I would suggest that your refusal to accept my offer could be viewed as unreasonable and I would ask the court to consider this matter with reference to the 'Overriding Objectives'.

    The offer of £ 1... per month( or whatever) is of course still open to you to accept.

  • I had a Halifax credit card I have been paying it off through pay plan. However I missed three payments of £18.00 due to financial difficulties. My wage was paid into my Halifax account and on the same day Blair Oliver Scott took out over almost all of my wage to repay the debt. They left me with £67.86 for the rest of the month. I am a single parent with two children - I cannot afford to feed them, pay my mortage or other important bills. is there anything I can do I'm desperate.

    Any advice would be welcomed.
