Lowell Financial and Portfolio

Has anyone got experience with Lowell Portfolio 1 and Lowell Financial.

Problem for my son who moved back home to sort his life out-did right thing and put him onto the Electoral role eventually. Then came letters from Lowell.

He once reacted by phoning them up and arranging to pay each month via debit card-but didn't do it as the more we thought about it these were total strangers. Too late to wait the 6 yrs with having made contact.

So now i have been writing, as i have some experience with letters of this nature, however after sending the last lot of letters both to Hamptons Legal and Lowell all at same address!, and using recorded deliveries, apart from them sending an Income & Expenditure sheet that we haven't filled out as he is on Benefits we explained this, but we have demanded 3 times now that he be furnished with the Original Signed Consumer Credit Agreement that they have ignored to this point-have said that he will give them the details they ask for when he has this document-but today another Standard letter threatning Court Action CCJ type. They are saying that Court Fees would be £50, Solicitors costs £50 Interest £ 30.21 on top of just over £300.

It was for a Store Card and he does recall signing an Agreement but it was several years ago at another address. We all know that often these things can get lost....

What can we do about this now-is there a Legal person here on this Forum?

    Hi,

    I'm afraid I have no experience of Lowell Financial, however my bumping your threading should help keep it on the top page.

    One thing I was querying though was whether, when you requested the copy of the credit agreement, you asked under the data protection act and enclosed a £10 postal order/cheque?

    You are unlikely to get anything back from them unless you do it under this legislation as they are legally required to provide this to you. Also, send registered post.

    Apologies if you have already asked under the data protection act but it was unclear from your post.

    No I did not send any money under data protection act as i thought that was used for reclaiming bank charges. He had the name of the Company they are acting for- only i don't know where it is now but there was a Forum someplace that had loads about this Company about the trouble that folks had had with them.

    Its the same process - your son is requesting information held by the credit agency relating to him.

    I have looked on the national debtline's web site, they state:

    "You are entitled to a copy of any files the creditor has containing the history of your account under the Data Protection Act 1988. A request for the file would not mean you were admitting the debt."

  • Does it state on Nationaldebtline that you have to pay the debt collector for information held, as it seems strange that they have ignored requests for signed consumer credit agreement.

    Sorry not to have been in touch - I had eye laser surgery on Monday so haven't been up to using the PC. Will have to make this one brief as left eye needs a rest!

    Have you looked on the National DebtLine's web site?

    The Data protection legislation is upheld by the Information Commissioners office and any companies holding information on individuals are liable for this, the information can be found on (there are FAQs online):

    Personallly, I wouldn't deal with the debt collection agency - go back to the original organisation that your son owes and request the information from them. If your son applies for a free credit report from Experian, the name of the credit agency will be listed.

    Whilst answering another query for someone, I found this on the nationaldebtline web site:

    Its a letter template, requesting proof of debt which only requires a £1 cover charge.

    £10 is only for a full dpa subject access report. For CCA information which is what you need its £1 send them that and get the requested info

    I wish I had found this Firum sooner.

    My wife had a letter from Lowells, usual guiff about her Barclaycard debt from about 6/7 years ago - I cannot be precise as we had forgotten it. She called, we are making payments @ £30pw. Are we too late to do anything about these Dudes. Also, I have a vague feeling that I might have included this in my final Barclaycard settlement (Equally, I might not have!), but we have no account number so they can't talk by phone, but they also will not reply to my letters. As they settled well below full debt, part of me thinks to let sleeping dogs die.

    I know that we did borrow this money, so I can't really moan too much, but just thought I'd ask. Bristol Rovers getting promoted has totally ruined my day:mad: :mad: , so I am looking for good news!

    I believe you only need a £1 for the request for a CCA.
    Have a read on here, might help shed some light.
