Council Tax - No demand.

I have been reading about Council Tax and I thought I'd ask here because I know there are a few of year that work in Council Tax Recovery.

Anyway, I was reading that a demand/bill must be sent at least 15 days before the first payment under the plan is due.

Well my Council have not, but they have sent me last years bill!

Does anyone know what my rights are here?

I hate paying Council Tax, if my Council didn't waste it on rubbish I wouldn't mind, but they spend it on things costing millions that they then have to make a use for because they are not fit for purpose!!!!

    Mine arrived today with a first payment on April 1st, so unless you've already had your mail there is still time for it to arrive 15 days before the first payment - of course, your council could still specify a date later in the month. That's if there is a 15 day rule at all.
  • Ok yes there is a 15 day rule, it's on the .gov site.

    But I haven't had mine today, so my 15 days will out of the window.

    They will want it on 1st April 13.

    Coucils send out the bills in a legal and timely manner. Royal Mail gets around to delivering them eventually.

    I'm pretty sure you have the right to pay your Council Tax.

    Anyway, I was reading that a demand/bill must be sent at least 15 days before the first payment under the plan is due.
    The demand notice has to give at least 14 days notice before the instalment is due but this is 14 days from the date it is generated and posted. Once it has been properly addressed and posted then the issue is outside of the council's control and service is deemed to have been made correctly.

    The onus on you would be a) to prove it wasn't sent at least 14 days before the instalment date and/or b) to prove it wasn't correctly addressed and posted and/or c) to prove you didn't receive it and the council were aware of that.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    In which case the person who it wrote it doesn't know the relevant legislation - http://www.legislation.gov.uk/uksi/1992/613/regulation/19/made

    the largest expense will be schools. totally unnecessary, i agree :)
  • Ok well I suppose the question is "what if?" they didn't post it within time, what could be done?

    Anyway I appreciate the replies, but to be honest I was talking about my Council building a great big art gallery costing millions, that a few years later they say they may have to demolish as it's costing too much to run and it's never been opened as yet - as for the schools post - sorry but I was being serious! :-/

    Ok well I suppose the question is "what if?" they didn't post it within time, what could be done?

    They then can't legally recover against the instalments due (until they have issued a new demand notice).
