Help - Debt Collectors are after my GF - HELP!!!

Hi all,

My girlfriend is having trouble with Orange. Her last bill was wrong so we phoned Orange and they said that they would re-issue the bill correctly, but haven't - they added a charge for asking for a PAC and didn't change the original amount.

As she couldn't be bothered to phone Orange, we wrote them a complaint letter instead asking for them to correct the bill or tell us what exactly she was being charged for.

This letter was apparently ignored as they sent an overdue account letter recently.

We wrote back saying that they hadn't responded to our last letter, so could they.

So, predictably, they have obviously sent the account to their debt collectors as she just got a letter from them today.

Could we have some tips on what to write them from all you experts please!!! Preferably, could you let me know what i should write exactly?

1) I think there's something we can say to say that we dispute the bill so they stop bugging us.
2) We should ask for correspondence to be in writing.
3) We should ask for a copy of the signed credit agreement - isn't there something about it being illegal unless they can provide this?

Also, who can we complain to about Orange's complete lack of customer service? OFCOM?

    Hey DDDK

I found this letter in another thread, I think it's the one to send requesting a signed agreement:
I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.

    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx.

    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not.

Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.

Not sure about the other stuff, but I'd suggest sending any letters to them recorded delivery. I'm pretty sure there's a section in a forum on consumeractiongroup.com about debt collectors, you might find more answers in there :)

  • Thanks PP,

I'll base my letter to them on that - but I'll try and check out CAG too (thanks for the tip off)

I can't believe they have just ignored both of the letters I wrote to them and the phone call we made to them. They're completely useless - very glad we have given up on them now.

Shop staff couldn't give a damn either!

Yep, I've had countless letters ignored by debt collectors! Get so tempted to phone them, but know that they'll just go back on anything they say at a later date  Hope you can get it sorted out!

  • Hi all,

I thought I'd post an update. I replied to the "debt collector" letter (which I decided was actually from Orange pretending to be a debt collector as the address was suspiciously the same on the pre-paid envelope the letter came in...) saying that as I'd not had a letter in reply to my letter, sod off until I get a reply and dropped in the I want a signed copy of the agreement etc etc to give them something to do in the meantime.

Funnily enough, after that, a letter came through replying to the original complaint letter and basically said, and I paraphrase: "sod it we've written it off because you're being difficult, but not 'cos we're wrong, alright?"

A few days later a bill came through showing the amount written off but actually leaving the account in credit by 1p

Should I write to ask for the 1p back?
