P45 & P60

Have just been looking back over my wifes payslips, she was given redundancy 10 months ago (not the few as I put in my other post - where does time go). Anyway I've calculated that she has overpaid her Tax somewhere between 500-600 pounds.

We are still waiting, although various phone calls etc have been made to previous employer, for her P45 but nothing. I work for the same company and recevied my P60 a couple of weeks ago, but as of yet still nothing for my wife.

Are there legal requirements for timescales by when employers have to have sent these, and do you get copies etc?

Any help welcome - as I would like to get this money back.

    If your wife was made redundant from the company 10 months ago then she will not receive a P60 from them.

    She should not have paid tax on her redundancy pay.

    Does your wife have the final pay slip from this job? Has she worked elsewhere since?

    With some more info I should be able to help further.

    No tax was paid on her redundancy money, but tax was paid on her salary in the three months before being made redundant. She was paid normally (PAYE) for the months of April, May and June 2006 -with tax automatically paid at the same amount as if she was there for the whole tax year - hope that makes sense. Was told at the time - she would be able to claim it back

    She has the final pay slip somewhere - we'll dig it out.

    She hasn't worked anywhere else since, not claimed benefit or anything

    Yes it makes sense :D

    It sounds like you are right too. If there is no P45 then I would certainly dig out that last pay slip

    Then you can call HMRC and ask them how you can go about reclaiming the tax. (With a P60 you can just write in and send them it)
