Property advice needed please

A few months ago, following a health scare, my ex wife gifted a house to my daughter's husband It was done this way to help avoid the taxes should she die. For the last couple of years my daughter has been trying to sort out her personal debts However last week she went BR and now the OR is showing a great deal of interest in the house arrangement. I do not fully understand the "gift" arrangement but in trying to help have a couple of questions. 1/ Can the OR order the house to be sold even tho' my daughter would not benefit from the arrangement 2/ Can the OR demand any money from my daughters husband for debts which occured before they married

While the OR needs to check the arrangement out, they will have no rights that exceed those that your daughter had. They can not order the sale of the property or require your daughter's husband to pay anything.

I am sure you are aware that aside from the OR sniffing around, you ex-wife may not be able to get state funded long-term should this be required in the future due to deprivation of assets.
  • Thanks very much for both your replies. I will pass on your comments re state funding
