I am hoping someone here can help. Apologies if this seems a long one hoping i can get all info in here and if it is in worng section please move to the correct one.
My husband took out a loan with Barcaly's with PPI prior to us meeting. At the time he was in a previous marriage so currently has no access to all the paperwork as his ex destroyed it after he had moved out. Barclay's are being rather pig headed on allowing him copies of any paperwork making his predicament more difficult to resolve.
Anyway. He took out the loan with protection after he met their criteria - medical details were explained and was told that as condition was in remission and had been for years he was eligible. At the time was working full time in good health. As a child was told he had juvenile arthritis but would grow out of it, had a few appointments up to the age of 16 but then all fizzled out. Saw a GP whenever he was under the weather but was not prescribed anything other than paracetamol or co-codamol. In 2007 whilst living with myself he was admitted to hospital after struggling to breath and with reduced mobility, investigations showed that he had a condition called Ankylosing Spondylitis and treatments began in November of that year. As he was still employed he was able to continue to pay the loan amounts each month until his wage was reduced because of sick pay which then went on to him being retired under ill health reasons. He is currently on disability benefits with health worsening.
He was not made aware until he was in Barclays local branch one day that he was able to start having the insurance take over the payments when he let them know he was struggling almost 6 months after becomming ill. A medical questionaire was sent to the GP and the payments began to take place pretty soon after. Each year he had to either have a telephone interview regarding is illness and symptoms or a medical review via GP. Payments around this marker were suspended until reviews recieved and then reinstalled. This time however a different GP has wrote the report, he doesn't know my husband so the information that has been sent is rather sketchy and not indepth like his own GP would send.
Have spoken with Barclays and cant get a clear answer as to why. In one breath they say it is because he was not symptom free in the 2 years previous to taking out the loan (have medical report which was initially sent to them stating otherwise) then in the next breath that he had to be symptom free 2 years after the start date of the loan being taken out. Was also advised this morning he may have been missold the policy and to look into that. But dont want to go rattling any cages if we can get the payments back up and running again.
Spoken with CAB this morning and all they can advise is a letter of complaint and to see where that goes. In the meantime he is recieving up to 3 phone calls a day both on landline and mobile with text messages on top from the collections department despite explaining the situation to them and asking them to hold off while he tries to get everything sorted out.
Have also spoken with GPs secretary this morning to try and get him to write a report rather than one of the other doctors in the surgery and are waiting a phone call about that. It just feels like his feet are in sinking sand and getting deeper by the minute which is also making his conditons worse with stress.
Does anyone know where we can take this further as rather hoped CAB would be able to help out to take the strain of my husband and to get it across more articulatly than we could.
