Please advise me on what course of action I should take. Yesterday I parked in Cardiff in a car park run by Vinci Services Uk. Ltd, on behalf of Land Securities. I purchased a ticket for 2 hours and placed it face up on the dash. As we got out of the car very strong arctic gale force winds were blowing, and we slowly made our way out of the open car park. On returning there was a charge on the windscreen for not displaying a valid payment! I can only surmise the "wind had flipped the ticket over" as the passengers got out of the car! The ticket was indeed upside down on the dashboard!!
Do I write to the company and include the Parking charge notice and ticket, and ask for these mitigating circumstances to be taken into account, or would they still want payment regardless, so pay?? 2ddesign

What they "want" and what they will actually get are two different things. You paid to park and you don't owe them a penny.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

you just need to provide a visual of the ticket along with the time that the ticket was issued...the only way they can charge you is if they issued the parking charge "after" your ticket expired....0

Oh dear....
Don't bother with this advice, they will reject any appeal regardless of what you send them, and they can't charge you under ANY circumstances as this would contravene basic contract law.Je Suis Cecil.0 -
Thank you all for your replies! As Vinci are members of the British Parking Association, they can find out from the DVLA my contact details from car reg. Should I first just send them a letter with mitigating circumstance anyway with the ticket (to prove I paid), parking charge notice (have photocopy's), even though they will reject my appeal. On the BPA website this company does not use debt recovery services, so I could ignore their rejection letter! 2ddesign

I would advise a soft appeal to Vinci, wait for them to reject it, and then a hard appeal to POPLA, refuting that Vinci have the necessary contract in place with the landowner that confers upon them the sufficient occupational rights to form a contract in the first place.Je Suis Cecil.0

Pointless to appeal to the first stage (scammer) and then not bother with the second stage - POPLA - which is 'independent' and will probably actually win this for you!
See any other thread on here about PPCs and you'll find stuff about doing a soft appeal to the PPC (like you suggested, mitigation) and then when they reject you get help here to word a strong, winning POPLA appeal at Vinci's expense! Nice!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yep that's an option - but I am more in favour of getting the stupid things cancelled, left, right and centre by POPLA. Not only does it cost the PPCs £27 a pop but if we get the POPLA appeal wording right and keep beating the PPCs then the % appeal successes will be very, very high, also very, very off-putting for the PPCs and even of interest to the Press!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
