Bankruptcy, divorce and mortgage

Hi,

I went bankrupt late last year due to large debts in both my sole name and joint with my ex wife, all seems to be OK apart from with the mortgage company on the FMH. My ex wife still lives there and my name is still on the mortgage.

I keep getting letters from the mortgage company demanding payment of the arrears (currently over 10k). My ex has made no full payments since we split nearly 2 years ago! I cannot afford to make payments towards it and keep a roof over my own head.

Anyway, I rang the mortgage company to tell them of my bankruptcy, but they say it's irrelevant and I'm still liable for all payments.

I really dont know what to do. As far as I'm aware my ex isn't working but has somehow managed to stay in the house. What can/should I do?

    The mortgage company are right in that BR only deals with unsecured debts so won't include the mortgage until the property is repossessed by them, after which it also gets dealt with by your BR last year (unless you sign anything that means you take back the responsibility for the mortgage, so don't sign anything). The mortgage company can contact you all they like but if you can't pay, you can't pay. Eventually they will repossess the property and then the shortfall once the property is sold will be included in your BR.

    Change your phone number so the company doesn't have your number, and just respond to them in writing to say you are not living in the property, no longer have the keys to it and are unable to pay.
