council bailiffs

hi will try to keep short .i arrived home today and found a seizure notice from the bailiffs for council tax 1st i knew about this . phoned council and in fact im in credit with them as i pay using a card at the shop the amount the bailiffs want is
first visit 24.50
levy 38.00
enforcement fee 120
nothing about council tax fee owing they put a seizure notice on paperwork regarding car on the drive. so im thinking of going to the council tommorow and see what advice they can and should give me.but any help members could give would be very helpful .
could the council stop the action ?

    It could be a clerical error on their part i.e leaving you a template letter with council tax written where your car company should be. Are you in arrears with your car payments?

    I'm afraid I don't have much knowledge about what to so hope someone will come along quickly for you.
    Debt free since 2014 - now saving for a mortgage deposit :heart2:

    If you think you are in credit with the council you need to speak to them tomorrow and find out why they think you are not in credit. Sort out your card receipts today so that you can run through your payments with them.

    Have you had letters previously to say that the council are taking you to court and seeking a liability order?

    PS could you go back to your earlier post and delete it?
    You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

    Is it for another property?
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Are they only persuing their costs ? - Have you been making payments to the council at the same time the bailiff's have been chasing the balance ?
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • bailiffs just seem to be looking for there fee . my last payment was on the 28 feb and means im now in credit with council tax for this year. so wanted to know if the council are obliged to inform them.the letter from the bailiffs was the first i heard about this and not sure how they have worked out there fees .many thanks for the reply s

    There's something odd here. The bailiff seems to have a warrant based on a Magistrates Court Liability Order. So where has it come from? There could be a few answers:

    1. Complete mistake
    2. Previous property
    3. Previous tax year
    4. Current tax year and you got seriously behind mid-year

    If it's 4, and the bailiff has done a first visit after the debt on the liability order has been cleared, that would be an interesting scenario, but we're not clear that's what we have here.
