Parking eye charge

Newbie Warning!

Hi All have been issued with one of these parking charge notices from the cowboys at Parking Eye, after searching these and other threads I have no intention of paying.

As I did my weekly shopping in the adjacent morrisons car park(spending well over the the £5 at which the parking fee is refunded by morrisons).

I believe I bought a ticket for two hours (had to enter reg before ticket is isssued machine) but may have entered the wrong reg as I had only had the vehicle a week.

After speaking to Morrisons who own the car park and being advised that they would not pursue a claim directly against me i was advised to inform parking eye that I shooped with them on the day in question as the parking enforcement has nothing to do with morrisons directly, I dont know if I should then ignore any further letters or reply to parking I that as I was a legitimate customer etc this charge should be cancelled as well as the fact that as they are not the landowner they have no legal right to sue me for tresspass etc,etc and that I have proof of purchase etc I consider this matter closed.

The PCN I recieved states that I breached their terms by either not purchasing appropriate parking time or remaining in the car park for longer than permitted, should not PE be more specific in regardto which terms I have broken?

    Welcome to MSE :hello:

Given what Morrisons have said I'd simply ignore the Parking Eye clowns - they are after your money and are fully aware that if they go to court to ask for it, they'll be laughed at. So their only option is to write threatening letters to try and scare people into paying up. Unfortunately, this too often works and is how they make their money.

These cowboys will say in their letters to you that they can affect your credit record, send bailiffs to your home, impose extra fines and fees for 'late payment' but this is all nonsense.

You can ignore, or if this was in England or Wales you can appeal and then appeal to POPLA.

It's a choice of ignore, or appeal, when POPLA is in the equation (which it is for a recent fake PCN issued in England or Wales).

Discussed on this useful pepipoo thread with input from broadsword and other experts:

    http://forums.pepipoo.com/index.php?showtopic=77301

Personally, I agree with them that we should be using the POPLA system as long as the appeal made is very strong with lots of important issues raised against the PPC. Also PE seem to have 'upped the ante' recently with people who ignore, with an odd small claim attempted (can be defended of course, but scary for people). Whereas they duck out of POPLA appeals from anyone who seems to know the score - so I say Parking Eye should be dragged kicking and screaming to POPLA every time.

They are scammers and you can shut them up by appealing and then getting help here with a POPLA appeal, if this was in England or Wales.

Here's a thread discussing a successful POPLA appeal re a Parking Eye fake PCN (they do not like giving POPLA verification codes and nor do they like showing their contracts with landowners!). And they do not own the car parks they frequent so that is a very important point you must read about on these threads and others, and understand about the case VCS -v- HMRC so that you can include it in any POPLA appeal.

    (If in Scotland it's a no-brainer = ignore!)

  • After PE asked for more evidence to justify my appeal (bank statement not being good enougth) suprise suprise.

I then spoke directly to the deputy manager and reminded him that as a legitimate customer on the day in question would not Morrisons look stupid as the landlord of the car park in question be instructing PE there agent to pursue this parking charge in relation to either loss of revenue or tresspass when no loss of revenue or tresspass occured, if not then for them to inform PE cancel this fake charge.

I recieved a telephone from the deputy manager today informing me that PE wil not be pursuing this charge and that I will be informed officially in due course, so hopefully this will be the end of the matter.

Having my eyes opened to this scam and after reading other posts on this forum I am now very wary of were I park and especially so were ANPR systems are installed as for Morrisons Chester Le street I will never shop again at this or any other store that employ these parking charlatans to manage the parking and will in future keep all parking receipts.

We should all boycott stores that employ these scammers and hurt the retiallers in the pocket.

    Hi All,

Today I recieved a letter from PE to effect that the 'parking fine' that on this occasion has been cancelled.

I would strongly advise anyone caught up in a similiar situation to firstly complain to the retailer(s) or shopping centre management company in the strongest possible terms in regard to the activities of these parking cowboys.

I will be E-mailing the CEO of Morrisons to complain about the practices employed by their agent and the effect this will ultimately have on their business, I will also however mention the assistant store manager who helped me sort this fake PCN ticket out.

I would like to thank all the posters on this site who without there valuable contributions I and countless others would have more than likely paid these scam fines as we simply would not have known any better.

    cheers!

Thanks for coming back to confirm this outcome. And well done for not just letting it lie and still intending to complain to the CEO of Morrisons for doing nothing to stop this money-making spy camera firm - with NO agenda for 'parking management' whatsoever - being allowed by the landlord to worm their way into a customer car park.

If the big Supermarkets get LOADS of complaints, one day they might wake up and smell the coffee and refuse to allow this scam in their car parks, then it would knock the PPCs' profits for six and send out a strong message to other retail parks and landlords about the private parking '[STRIKE]industry[/STRIKE]' moneyspinner.

Waste of time, they are cut in on the Scam.

However Contact the planning office for consent on planning, are they breaking planning conditions.
Contact the Council business rates team, are they claiming free car park status yet issuing charges and avoiding business rates.
Also a new one, the water authority Board, a business car park is charged drainage rates, a free one is not.
I take it is says "Parking charge"
point out it is not a fine, but a charge contract for parking "as they claim".

Make them pay the full whack, they will soon think twice about how much money they get in kick back from the parking scammers.
    Be happy...;)

How are legitimate complaints a waste of time ? The status quo will never change if there are no complaints. I encourage everyone to complain to the retailer.
