    My husband now has enough money in the business to pay himself a wage each month. He has had no payment since he started the company in October. The accountant will prepare his payslips to show back pay for November - March, but the payments will go into his account before the end of March. His pay for the next tax year will continue at the same level. Will csa accept the March payment as covering November - March or will they try to apply it all to March to create a higher assessment? He is not trying to avoid paying csa he just wants to avoid any problems.

    this is refreshing, as most blokes don't seem to care..!!..
    my NRP owed his own company ltd aswell......until I did a variation, and within 2 weeks of me doing that, he gave up his company, (which he has owned for 10 years), signed it over to his 'wife', gave her his shares, his salary, his dividends everything, now pleads she supports him, as he has no job....he has seen is son for about 35 minutes in total, and baby is now 21 months..!!....

    I am at a loss about what to do, as it always seems to be supplying evidence, he just says this happened, that happened and they believe him, I have to dig and dig to find stuff out...
    I don't know what to do....:-(..xx

    Cookieshop I am sorry to hear that your ex has behaved so badly towards you and your child. Have you asked your MP to help you with the child support case? if not I think you should. At least by doing that your case will be given more priority. There must be something they can do.

    This has all gone terribly wrong, I hope someone can tell us what to do next. My husband had a call from CSA this morning telling him that it was too late to notify them of pay now as they intend to close the case and refund all the overpayments he has made since he became self employed. He asked them not to close it as he knows he is liable to pay for his children and he now has an income that can be assessed, but they refused and said it was too late. From the time he became self employed he made them aware that it would take several months to establish a cash flow and pay himself and as soon as he had an income he let them know. It seems foolish to close the case when there is now an income.

    This is going to cause a lot of additional resentment to the PWC as well as financial hardship and that was the very last thing that my husband wanted. Sadly she refuses to have any direct contact with my husband so there is no way of reaching an arrangement outside CSA. Is there any way that my husband can challenge the decision to close his case? If not can he open another case? The children still need to be supported one way or the other.

    Why would they close the case...??? If the children are still eligible then it would not be closed just changed to a NIL assessment surely..???

    Just a thought.

    Kevin that is exactly what we are trying to understand. I even got my husband to phone them back to confirm that he had understood properly! They were adamant that it has to be closed and my husband's overpayment has to be paid back to him. This is despite him now having an income, he has been able to pay himself a salary covering Nov to March so he should be paying child support. If they would assess his payslips (from the accountant) his CSA liability would wipe out the so called over payment. It makes no sense at all.

    I don't think the PWC has asked for it to be closed as it is not in her interest to move him from CS1 to CS2. We are totally confused.

    The children are still eligible, the youngest is 14, her sister will be 19 in a few months but she is at college so she is still eligible and will remain so for another year.

    The best thing you can do now is reopen another case after they close your current case. It's not worth fighting the CSA to keep the case open if they are being adamant. Take the refund and keep it just incase the PWC requests it from you.

    It's not your fault if the PWC doesnt want to communicate re maintenance, it's not your fault that the CSA are closing your case.

    Thank you sfm82, we will put the money aside as you suggest. The sad thing is that none of this was the fault of the children and they shouldn't have to cope with less money coming in. To be fair, despite many problems in the past I don't think this is the fault of the PWC either. I am sure she will be absolutely furious about it and it will just make a difficult situation worse. The sad thing is that we tried so hard to do the right thing, but it has all gone wrong.
  • To echo the other advice here, all he can do is ask to open a new case himself. He'll be assessed on the income figures for his self employment.

    The PWC could refuse to accept payment on the new case but wouldn't b able to close the case.

    I don't really understand how/why the case is closing here to be honest, it could only really close if the PWC has requested it.
