    The only thing I can think of is they give her a weeks notice instead of the other way around and she's out of cash for two weeks before the new job starts.

    If they dismissed her they would need to give her at least 2 weeks notice unless the dismissal was for gross misconduct.

    The only fault lies with your OH for telling her line manager she is off before she needed to.

    Lesson learned there.

    Bit difficult not to tell your line manager when you need a reference from them!

    She should just carry on as normal at work, say nothing more, then give her 1 weeks notice on Friday 29th March, stating that the following week will be her last week, with her last working day being Friday 5th April.

    She'll need to work out any holiday owed.

    If they suggest she hands her notice in sooner, she should just say that she hasn't got a contract for the other job yet, so nothing has been finalised, so will not be handing her notice in unless it's necessary.

    Your wife should put her resignation in writing so that she leaves on Friday 5 April (if this is what she wants) in accordance with her contract.

    In the meantime, she should say nothing else to her manager (they are not her "friend") or be tricked into doing this any sooner.

    Will your wife have any unused holiday entitlement when she leaves ? - if so, it might be worth using this up in the meantime, otherwise she may find that this is accidentaly not included in her final pay (not that they can do this, but it just causes additional aggravation that she does not need).

    Do a search on this forum - there are a few similar posts where somebody thought that they were doing the "right" or "nice" thing, and their employer reacted in a similar way.

    Thanks for all the advice folks, it confirms what I/we thought.
    She's been in touch with ACAS just in case and they said the same thing (we wanted to be well-armed with as much info as possible).
    She emailed her boss last night (now keeping everything in writing) and is expecting a meeting with him today to sort out what's what.

    I agree - she is in the same position as she was last week (and will be until she hands in her notice).

    It sounds as though you may be worrying unnecessarily.

    Statutory for the company would be 1 week per year so at least 2 and maybe 3 depending on how close "best part of 3 years" is.

    SO if they want to let her go thats paid upto the 22th allready.

    Plus acrued unused holiday.

    WHen is the holiday year and what is the holiday allowance and how many have been taken(include BH in the numbers)

    Thats for them, but should be checked.

    The company cannot give less than statutory so the OP just refuses to give notice and then the companyy have to pay 2 weeks minimum to get rid.
