Tesco didn't take payment

Ok ok, I know I should pay more attention to my bank account!!

For my birthday in August I treated myself to a little samsung tablet.

Tesco have now contacted me 7 months later saying they've just realised they didn't take payment! :eek:

I can't afford this now!! What are my rights? I've told them they can have the tablet back, but they're not happy with that, they want me to pay the full £198.

Incidently, the tablet is now only £150, and as a true money saver, i used money off codes and quidco when buying it. the quidco tracked and has been paid confirming that I only "paid" £160 for the tablet, but I didn't keep a record of what money off vouchers I used, so they won't even let me pay the reduced amount! (not that I can afford that either) :(

They emailed to tell me they'd not taken the money and wanted me to now pay up, I thought it was a fake email, ignored the first two, it was mostly in capitals and I couldn't trace the number it wanted me to call back to tesco's, but in the end I rang their helpline just to check it was fake, and it wasn't.

grrrr. please help!

    You do have to pay them - but only the amount agreed. Do you have an email from them with the payment receipt on, or confirming the order?

    I'd be going back to them to dispute the amount they are asking for. Do everything via email so you've got a trail of correspondence.

    You bought it online? If you did you should have an electronic receipt somewhere - even if its only in your Tesco online account. It doesn't matter the *reference* of the voucher - if the reciept says one was redeemed on that then it means it was.

    Provide them that receipt and arrange to pay the agreed amount.

    You bought something as a treat and now you can't afford it! Have you spent the price of the tablet on loose men?
  • Purchased in October and now chasing me for £160 payment.

    Quote them terms and condition 18.1 where it states that they will take payment at time of order.

    So far they have agreed for item to be returned but I'm too peed off for that or I can repay in instalments,

    I will be seeking legal advice as it is a problem caused by tesco

    I think they will probably allow you pay in instalments. Be polite to them and see what they say.

    Did you check your bank statement and Tesco online statement? If so, how much did you pay for the tablet?

    You still technically owe the money

    If you don't pay then they will have to take you to court or instruct debt collectors.

    You owe the money, so you need to pay no matter what (or they could legally take you to court for the full amount), but you ONLY need to pay the agreed price, so £160. Your options are:

    1. Borrow the money from someone to pay for it
    2. Pay in installments
    3. Sell it on Ebay then find the excess money by selling something else.

    Perhaps a lesson for the future is not to buy luxuries you can't afford? Clearly that £160 was needed for something else, otherwise you'd still have it.

    Utter rubbish.

    You have this peculiar assumption that the OP has spent every penny they have received in the last 7 months on essentials. Where on earth have you got that idea from?

    You don't think it's more likely that they've looked at their bank account before, say, Christmas shopping, going out for a meal, buying new clothes, or any of thousands of other possible spends, and seen they had sufficient money? Especially some months after buying the tablet, when they'd no longer be expecting the money to go out of the account.
