Car while on benefits

Hi, I have a friend who has just gone BR and they have a car that's worth £1000 tops (10 yr old car) and claims benefits, they have a young child that needs to go to regular hospital appointments and an elderly mother that relies on the car for transport/shopping. The OR is talking about taking the car is there a way around this as the car is essential for the hospital and elderly mother?

In my opinion I do not think the OR will be bothered about a 10 year old car that you say is worth £1000. How much do you think said car will fetch at auction? £200-£300 tops and take the fees out of that.
I would suggest asking the OR not to take the car and explain the hardships it would cause and also the actual AUCTION value of the car.
I think you will find that it is not really an asset, in the true value.
Just my opinion.0 -
They have done that and the OR said they may need written letter from the doctors/hospital to confirm that the young child is going to several appointments at several different departments and locations and a letter from the elderly mothers doctor. It would stop them from taking the young child to the hospital appointments as some are on the same day (10-11:30 then travel 5 miles to the next appointment at 12).
They have also been asked to get the car valued (bit of an odd thing to do I thought).0 -

Ge the car valued for FREE on webuyanycar.com
:D:D:D
That will value the car at about £50 - £70. That will let them off the hook.0 -
My car was valued at £400 and the OR still wanted to take it. I got a letter from my GP with regard to my disabilities (I have a blue badge, and would be stuffed without it) and the OR accepted that. I was given 6 days though to get the letter to them so I had to see a totally unknown to me GP as I couldn't see my own in time, OR said if no letter by Monday it would be collected. They are fairly strict about it, even if they would get pennies for the car they will still take it if they do not decide a car is exempt. They cashed in someone's premium bond worth £1."Our prime purpose in this life is to help others. And if you can't help them, at least don't hurt them." Dalai Lama0

Thanks for the reply I think I will get them to ask for doctor/hospital letters just in case the OR calls again.

Hi there
For reference, valuing a car online can be done more reliably at http://www.parkers.co.uk/cars/prices/used/
although free valuations are only available for vehicles from 2003 onwards (so may just about cover this particular car) - a fee applies for anything older.
The likes of webuyanycar.com are designed for quick sales and may not give a true reflection of market value in the OR's eyes.

Thanks for all the replies. It's just a waiting game at the moment as they are waiting for the OR to call back.0

Good news, my friend received a letter earlier today from the OR and they have no interest in the car.0

I knew it.
Basically a non starter from the off, way to old.
I had an 03 Passat Estate when I went under and she had no interest in it, but showed an interest in the Personal Registration Number on the car as it was worth more, but as my Grandmother bought it for me 3 weeks afore she passed away she let me keep it.

This is misleading.
The age of the car is irrelevant to the OR...they have agents who maximise whatever value from a vehicle can be had...even scrap value.
With vehicles, firstly, argument has to be presented to have a vehicle exempted as an asset.
Once that exemption is agreed, then the value of the vehicle is looked at. [This is where the current £1000 limit of value comes into play]
Even a car with but a couple of hundred in value will be taken, if it cannot be exempted, or the OR's interest isn't wanted for purchase.
{ I had a second vehicle, I purchased the OR's interest in it.......for it's scrap value......at that time, £90! Arrived at by negotiation}
BR does not preclude vehicle ownership. Ability to fund that ownership does!
The Court forms specifically demand information regarding vehicles owned...[assets]....every V5c that is registered to the petitioner needs to be included.....regardless of whether the vehicle is running and used, or a box of bits, or owned by one's Granny in reality.
What counts is the description, or, the notes as to actual 'ownership'...
The OR is tied by the Rules......No, I don't think all other drivers are idiots......but some are determined to change my mind.......0
