Fraud activity in my bank account via PayPal

Hi all. Yesterday my wife was going through a bank statement and realised that over £300 had been stolen via a PayPal direct debit mandate. We then went and checked previous months as far as we could until October and we've had nearly £1000 stolen. We don't have any PayPal account linked to this account in any way and have never used PayPal on this bank account.
We then called the bank who said they will block further attempts and refund the £300 from this month. They said we needed to call PayPal to claim the rest of the stolen money.
I then called PayPal who confirmed over the phone that there was an active PayPal account connected to my bank account but they couldn't give me any further details about that account. They said they would send me an affidavit which I'd need to sign and return and in the mean time they would investigate further.
Today, I have just received an email from their customer care team stating their is insufficient evidence to back up my claim for unauthorised activity and they would not be returning the stolen money!?

I'm calling them again in the morning as I'm missing at least a further £700!

Is there anything I need to do in the meantime? I will also speak to the CAB regarding taking them to court if they further refuse to return my money.

Any help would be greatly appreciated.

    I suggest you go back to your bank and ask for a full refund of all the unauthorised payments in accordance with FSA rule BCOBS 5.1.11


    I also suggest you e-mail Paypal back and tell them that notwithstanding that you have never set up an account with them, they clearly consider you to be their customer. Therefore you are making a complaint against them that they have made unauthorised debits to your account and expect them to deal with it in accordance with the FSA's DISP rules.
