Having a Panic Moment

Hello peeps,
A bit of background.......
Back in Dec 05 my ex b/f (waster) drove my car while uninsured & crashed it. The car was undriveable as a result (or so I thought) and it was abandoned outside his house. I reported him to the police & he was later charged. However in the meantime there was a notice put on the car by the local authority to say they were going to remove it. The next thing I knew it had disappeared and assumed that the local authority had removed it.
I was under alot of pressure at the time and was very ill with depression etc , my insurance had lapsed so quite frankly I ignored the situation and buried my head in the sand.
The problem now is that when I declared BR I stated that I didn't have a car but I did have a CCJ against me for damage to the other vehicle involved in the accident. Obviously the OR had wanted to know the details behind the CCJ and so I told them everything I knew & that my car had been scrapped (which I honestly believed to be the case).
I have received a letter from the OR to state that DVLA has informed them that my car has not been scrapped and that it is still registered in my name. Originally I thought no problem I'll just ring the local authority and get written confirmation that the car had been scrapped. That's when find out that it hasn't been scrapped, they went to lift it but it had been removed!!! So looks like the car was stolen!!
I now don't know what to do. I have given the OR details as I saw them but now obviously realise that they weren't the facts. I'm scared and don't know which way to turn. I need to respond to the OR's letter but don't know where to start
Any advice would be appreciated

Hi Red,
You told the facts to the O.R to the best of your knowledge and belief at the time; you've done nothing wrong. Just write and explain the assumptions you made at the time and how they've subsequently been overtaken by events.
I'll bet you don't hear anything else from the O.R on the subject.

I echo Rich's response. How could you possibly know the car had been stolen!
I'm surprised the DVLA didn't contact you about the SORN car off road thingy.
Presumably you don't want the car so I would leave it to the OR/DVLA/Local Authority/Police to find it.:D if they can be bothered :rotfl:0 -
I would ask the local authority to confirm in writing that your car has been stolen, report it to whoever necessary (maybe including the police) and forward the details on to OR. I don't think you have anything to worry about.BCSC Member 70:j

Yes. Report it to the Police.
They will give you an 'incident number' which can be provided to the OR. This along with the letter gives you cast iron proof.

Thanks peeps. Why am I so scaredof the OR? Not sure the guy from the council will provide me with a letter but he didn't with hold his number when he called so I've got that & will state it in my letter to the OR.
Not sure whether to report it stolen, it was nearly 18 months ago...wil the OR not think it strange me doing it now? I have already had SORN documents from DVLA but (yet something else I ignored) they referred the debt to a DCA and as far as I'm aware it was included in BRBSC Member 59 - AD 29th March 2008

Why not? If you have only just become aware that this may have happened then this should be OK.

Just reply to the OR clearly and fully. The way you've put it in your posting here is fine. The OR wants the full facts and the truth. The OR's office will have come across this kind of thing often. Just be open and honest with them as you have already been with them. There is nothing to be worried about. Everything you say to the OR you are expected to say to the best of your knowledge information and belief and that is all anyone can be asked to do. Do you have any other evidence you can add? It is useful to say the least to reply to the OR promptly his / her enquiries can then move on a stage, based on your reply.
Have you since reported the car stolen? You should conside this, because if it is still on the road and registered to you, you could be caused a lot of hassle if not worse, if anything happens with / to this car. It may be a long time ago nut if you've only just learned it was stolen then still report it..Also report it to the DVLA because otherwise you could have problems in being liable for the road tax.
I don't know so much about the DVLA but know a fair bit about bankruptcy. Hope this helps.0
