Capquest!! should I let them get on with it?

I received a phonecall from Capquest about 3 or 4 weeks ago asking me why I have not been paying anything on my 2 accounts I owe.

I told them I have been paying 2 standing orders for £7.50 each every monday for the past 6 months. They said I must have the wrong references could I check it for them. I have the correct references and account details and have proof that I have been paying them for 6 months.

I received a letter this morning asking for immediate payment or face legal action.

I absolutely refuse to ring these companys up as it costs me money and they dont seem to have any other contact methods other that post which also costs me money (tight I know but why should I)

Should I let them get on with it and let them cover the costs for a change?

    I would think that if you have proof that you have been paying money to them, then it would not stand up in court. It could be just their standard bullying tactics to try and get you to pay more money by frightening you about court.

    On the other hand if it does go to court then you MAY get a judge who sees things their way not yours and says you have to make higher payments. You can ask for this to be set aside but it does take time.

    I would suggest having a chat with the CAB and see what they think is your best course of action.

    Could you not write to them and explain that you do have the correct reference numbers etc?

    Personally, I wouldn't sit and wait but I like things to be sorted.

  • I made an arrangement with all the people I owe money to, to pay it off £7.50 per week and have not missed a payment on any yet. I did try debt management but was too expensive and thought i'd try make arrangements myself. So I have a written agreement that Capquest have accepted £7.50 per week.

    I dont see why I should go out of may way to correct a mistake they have made. Everyone has to learn by mistakes even debt collection agencys.

    I agree with CG, Put it in writing and keep a copy as proof. If it did go to court you can show then that you have made every effort to sort this out and that there are wasting everyones time.

    Also remember that even if you are in the right these idiots could cause you further problems and more charges if you let it continue on to the court stage.

  • I'm one of the very few people that are not affraid of debt collection agencys and have on a few occasions drove hundreds of miles round trip and visited them myself. This is how i managed to make arrangements myself. If this is not commitment I dont know what is.

    I see where your coming from but your forgetting that they dont give a !!!!!! about you or your circumstances. To them your just another number on the system.

    If you dont sort it out you face further paperwork and te hassle of actually going to court. If for some reason you cant then turn up you risk the chance of a CCJ and all because of your stubborness to teach them a lesson.

    The choice is yours but for the cost of a 1st class stamp it seem s like a lot of hassle.

  • Prime example of me visiting a debt recovery company.

    My wife was hounded day after day by a company who would not accept les than £60 a week even though we sent them a financial statement. They even hounded her into a £60 instant payment from my card whilst I was out of the house. Without my verbal aggrement this is illigal.

    I got in the car, knocked on the door and now we pay £7.50 a week. These companys are nothing but bullys to the weak and vulnerable.

    I to am not scared of dca as I now know my rights but its a seperate issue. they have made a mistake what you could easily sort out.

    Quite rightly you feel aggrieved about having to do it but it seems to me that you may be cuting of your nose to spite your face as the old saying goes.

    To be perfectly honest I have had enough of sorting other peoples problems out I have better things to do like make the money in the first place to pay off these debts. I rang them 3 weeks ago after the initial phonecall with all details of standing order.

    Now it seems they have made a mistake but want me to put it right. Not this callsign i'm affraid.
