Rates payable on car park

I have been asking around in Belfast for carparking.
I emailed an estate agent, who has advertising boards in underground carparks etc.
I have been told by them that you pay rates of £37 a month, plus £104, plus VAT. It is usual for residential parking, and not commercial they have said.
The Land & Property agency, said that you only pay rates on something you own.
These are carparks like Lanyon Place and around there, underground, under commercial buildings.
Can anyone advise that you pay rates and vat on a car parking space.. never had to before.:(

  • Yes, rates are due on car parking spaces - you mean as in enclosed ones in a formal car park, as opposed to a street one? In the latter case rates would not be applicable.

    £37 per month in rates does sound unreal - the actual figure should be I imagine £50-90 per space per year for car parking slots.

    The owner has the liability for CT. unless this has been agreed that your usage is plus a CT contribution that you have agreed to.

    Not first hand knowledge... But there was a thread on here recently about unpaid rates on a rented property.

    Conclusion seemed to be that whether the renter pays the rates directly, depends on how the agreement is drawn up. Probably similar on a rented parking space.

    Can't comment on the actual figure quoted... how does it match up to reality? The actual rate should be available from the authorities.

    That only applies to domestic properties. Car parks are non-domestic.

    This wouldn't be Philip House would it?

    Where I work, for some of the car parking spaces the rental cost includes rates and for others we pay rates separately - it depends on what the landlord prefers.

    I know what you mean but for commercial rates the tenant is always responsible. For domestic the tenant is only legally responsible if the CV is over 150k (I think). So a car parking space will have a CV of a few thousand but you will still be responsible as it is commercial, if you get what I'm trying to say rather poorly.

    This is wrong. For non-domestic units, it can be either the tenant or landlord responsible as stipulated by the lease agreement. It is not the same as domestic rating where the rating act predetermines liability in the majority of cases.

    If the landlord has not built into any lease agreement responsibility for rates a tenant is under no obligation legally to pay them; and as no obligation exists under lease the LPS can only pursue the landlord for outstanding rates. Whether or not a verbal arrangement exists between the freeholder and leasee is neither here nor there.

    Very plausible that they did say that. They're completely useless.
