Asda returns policy- need help

Last Thursday I purchased a PAYG mobile phone from Asda in Chatham.

I gave thwe phone to my teenager but when she tried it out we found that the ear speaker doesnt work- hence she cannot hear when making or receiving calls

However we have mislaid the receipt- it probably got chucked out amongst loads of stuff at the weekend.

Isd there any way we can return it without the receipt?

    If you wish to swap it for a new one then I don't think there should be much of a problem, they will know its a line they have sold and it is faulty and therefore have to replace it.

    Some stores even log the IEME number when selling them in case of returns (but this is store specific, not a company policy)

    If you want your money back this may be difficult but if you had access to internet banking and paid by card i'd try and print out a statement to show you did buy.

    There is a facility to search for transactions but it depends how helpful the member of CS is with you.

    I'd just pack it up and take it back and politley explain the situation.

    They do not HAVE to do anything.

    Did you pay by card? If so print out the statement and take it with you - it is as good as your reciept as proof of purchase in the eyes of the law. Asda should refund it no problems.

    Yes I paid by card. But surely they have to sell items that are fit for use? A mobile that you canyt hear calls on is simply not that

    Under the sale of goods act the item must be fit for the purpose it was made for. Those are statutory rights. If you still have the box and it has the iemi number on that would be proof enough, Proof of purchase does not only constitiute reciept. It can be a bag, sticker or anything that can identify where the item came fron, including logged serial numbers.
    IEMI numbers would be logged in case of theft.

    No. In fact the trader doesn't have to give you a receipt in the first place so it would be unfair to say that you had to produce one. However, it might not be unreasonable for the shop to want some proof of purchase, so look to see if you have a cheque stub, bank statement, credit card slip etc., and this should be sufficient.

    Yes they have to sell things that are fit for use - however without proof of purchase they don not have to do anything. Taking in your statement is considered proof of purchase.

    asda have a new policy that came into affect a couple of months ago that they will exchange for any reason wehter its faulty or you just dont like it, it might be harder though to get your money back with out a reciept i would print off a bank statement if thats how you paid, just be nice while asking cause i know at our asda if a customer is rude to the point of obnoxious they are less likely to be helpful. and with out a recipet if it has gone down in the sale they will only give you the reduced price. goodluck
