I have been off sick for nearly a month with work related stress. I had
made a complaint about health and safety before I went sick and the management took it to grievance stage 1. I have a two hour meeting on Monday around my grievance and should also be fit for work next week.
Even though I should give a months notice I don't want to go back. After all what has happened I feel for my health and safety and also feel threatened by other staff who I have reported.
I'm meant to give a months notice but just can't go back because I would always be watching my back. I'm happy to go to the grievance meeting but can't see what it will achieve if I don't go back.
What can they do if I refuse to go back on safety reasons?

I really feel for you, it's an awful situation when you feel work is affecting your health and wellbeing.
I'm no expert, although I would think carefully about just quitting because that can have serious repercussions. Your employer may be able to make some changes in response to your concerns to help you go back, and it would probably go better for you if you give them this chance.
If you quit without giving notice you'll be in breach on contract. I'm not sure you're eligible for benefits if you quit a job, and also it will affect a reference for a future employer, which could make this difficult as employers usually ask for a reference from last/current employer.
It may be worth speaking to someone from CAB? If you really feel you can't stay, it would still be best to work your notice, but CAB could advise you about your rights and whether you could claim benefits if you quit.
All the best to you.0
