Ex husband entitled to half equity

Hello

Just a quick question...

My ex husband is currently paying around 15% towards mortgage, which is in negative equity by a substantial amount.

If ex was to stop paying and I continued with payments until such time as in equity (around 7 years worth) would I automatically have to share equity with him or is there a part of divorce that will take away any right to equity or do I just have to bite the bullet if I want to keep the house? :eek:

Any comments appreciated.

    Do you have a solicitor?

    As you need to formalise any agreement in the form of a financial consent order.

    What did you agree to when you divorced ?

    There's nothing in a divorce which will take away his right to some of the equity (if there is any) It can be negotiated between you but this should have been done when you divorced.
  • Not yet divorced so I can check this out...

    Will ask solicitor but I feel that equity will have to be shared no matter who has paid what up to remortgage or sale, either of which is a long time off yet :-)

    You can agree whatever you like between you.

    I bought my house, i put down the deposit. My gf pays half towards everything currently. So we agreed that if we split up, i get the first £15k anything else gets split.

    Thats a private agreement we have and it was agreed when we were on good terms (we still are) depending on how amicable it all is will determine how easy it is to arrange.
