NRAM Breached DPA

Hi

I received a letter from NRAM at the weekend informing me that a Mortgage statement, requested by me, was sent to another NRAM customer by error. An unacceptable breach of the DPA.
In the letter they have said that they will give me £250 if I agree not to take the matter further and there will be no further action taken on my part. Almost like they are paying me to keep quiet.

In NRAMs case, it is all about the money for me, I intend to get more out of them than £250.

What are my chances of getting more, any advice will be gratefully received on how best to proceed.

    You will likely get the equivalent of your loss, to put you in the position you would have been. How much have you lost, oh nothing, had they not said you would never have known.

    Take the money, and be grateful, looks like a very generous offer.

    Surely its not just about financial loss ?
    Would you send your mortgage statement to me even if you would be sure you would incur no financial loss ?

    That aside I would take the 250 . Seems reasonable compensation for the breach of privacy .

    So if the postie was to deliver it to your neighbour by mistake and they open it. What then?

    £250 is very good for a minor data protection breach like that.

    Virtually none if you go to the FOS. The FOS average award for inconvenience is less than £250. Plus, if you go to the FOS, NRAM may withdraw the offer as it probably is just an amount to get rid of you. If you are going to incur them more costs, such as the FOS fee, then they may as well withdraw the offer and let the FOS award a lesser amount (£25-£50 would be more typical). Indeed, the FOS is not there to punish. So, it may decide you are not entitled to a penny as you have suffered no loss or inconvenience.

    The IC wont be interested as its a minor clerical error and not a widespread issue. A reminder of responsibilities letter from the IC to NRAM would be the likely outcome from them.

    Id be over the moon with £250 for a letter going to the wrong address.

    It makes me laugh, people arnt allowed to make mistakes these days without the where theres blame theres a claim brigade coming out.

    To be honest, if they had offered half that i would take it - not because im desperate for the money but because its a pretty good offer - too much in my opinion.
