Problems with HSBC & Payplan

I have un-secured debts of over £80K (loans & cr cards) covering 12 creditors. I am currently 6 months into a 30 yr DMP with Payplan. Currently 11 of the creditors have accepted the DMP & frozen the interest. However, my former bank HSBC where i had a current a/c, loan, & cr card have refused. HSBC cr card have accepted the DMP & frozen the interest the problem is HSBC bank.

They bombard me with calls on my mobile (changed landline no. & went X directory) & i get numerous letters off someone called H Daniels, Credit Services Manager threatning allsorts & accussing me of not contacting the bank about the situation (this is a lie).

I originally wrote to my old branch before xmas to close my current a/c & explain my circumstances & givie my Payplan details. Heard nothing back & then the letters & calls started.

Rang the bank several times on the number given for H Daniels but always get put thro to India who can't understand what i tell them, they just demand payment in full & refuse to put me thro to someone in the UK.

Then made a personal visit to my old branch who agreed the bank is being "high handed" but they can't help. They also confirmed that the current a/c was never closed & that the STO for the loan is being bounced racking up bank charges every month (when i left the bank the current a/c was £3 in cr & i was never o/drawn). Apparently the money from Payplan is being put towards the bank charges & not the loan.

I have sent several e-mails to my case officer at Payplan about this & have had no response, i have sent messages via Justabank (name of the case officer on their is different from the one i was given in Payplan letters) no response, posted copies of the HSBC letters again heard nothing & finally rang numerous times but can never get thro.

I have also decided to bankrupt later in the yr & wanted to talk to them about that.

My last phonecall with HSBC was quite heated. I told them i can't give them what i don't have & if they don't like it take me to court or give it to a DCA.

Should i now just ignore them.

Any advice is appreciated.

    Certainly there are MANY threads which highlight similar 'treatment' from HSBC.
    Firstly, you should talk to PAYPLAN, who may be able to talk to HSBC on your behalf.
    Secondly you should WRITE to HSBC and point out that, despite your many requests, their call centres continue to 'harrass' you, in contravention of the OFT guidelines, and that you intend to report them to the FSA and other Statutory Bodies.
    Thirdly, you should set about reclaiming ALL penalty charges that HSBC have applied to your account over the last six years.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    Sorry to hear you are having problems with PayPlan. They are normally good. :(

    Yes. If HSBC take you to court to get a CCJ, the court will rule that you should pay HSBC an amount in proportion to your debt with them. This is:

    (Debt to HSBC) divided by (Your total unsecured debt) multiplied by (your income after essential living expenses are deducted). In other words, exactly what they will receive in a DMP (I think) :)

    So they are trying it on.

    I would write to HSBC making a formal complaint using there complaints procedure and say that if you do not make a satisfactory conclusion you will take it to the FSA.

    Basically in situations like these they are not likely to be helpful but they should not stand in the way of you trying to deal with things, what they are doing bouncing standing orders etc is actually increasing the debt when you have asked to suspend interest to commence a payment plan. In the letter tell them every contact you have made, list all the letters etc and keep sending them the small amount monthly whether they have accepted or not.

    This is what I did with Lloyds TSB and I got a refund of charges and interest back.

  • I spoke to HSBC today, after getting a letter from them saying that they were 'looking forward tor eceiving my repayment proposals'. I thought that was quite good of them, really. I just need to give them my permission to deal with third parties (Payplan) in writing. I owe £8000 to them in current account and loan charges. Hopefully they'll be nice.

    Hi, I 'm a newbie and this is my first post but I just wanted to say that I was in exactly the same position as you last year.
    We started a DMP with Payplan in Nov 2005 and HSBC finally agreed to our offer in Feb this year! 15 months!!
    Payplan told us that HSBC are always difficult and always threaten legal action but that they never carry out their threats and always come to some agreement in the end.
    As long as you're making payments each month there's not much more you can do if they wont listen.!
    Worry is like a rocking chair - it keeps you busy but it gets you nowhere.

    Making payments as per what Payplan say you should is important. If by some miracle they did take you to court, then you would be able to show that you have not been ignoring the debt, which will go in your favour I believe.

    As regards the harassing phone calls. I think there is a bt service called choose to ignore, which means their phone number will be barred from your phone. I think it is free for the first month. So it may be worth checking out. If they can't get through to you for a month, maybe they will give up?

    I would also second the previous advice about writing to them to officially complain. And ask again that all business is conducted in writing. If this does not work, I gather that tell them that their call is being recorded (even if it isn;t, though you could get a cheap phone recorder anyway), tends to make them much more polite, if they continue the phone call at all.

    I too am having a nightmare with HSBC - fine with the CC but the bank ac and loan - big problems. Only putting the loan and o/d repayments into the o/d for example. However, they have been quite good and have just rang 'normally' but are pushing me for a managed loan, where they would inclde the CC (so from no interest it would then go to interest) and therefore also compound my loan interest(already included in the amount) and add more interest. Not really going to help my situation.

    Anyway, just wanted to say you're not alone and I do hope Payplan get back to you soon. Seems a lot of people are having major problems getting in touch with them.

  • I'm hoping HSBC treat me ok, as I will be paying them £110 from next month (think I was paying them £160 initially) for the grad loan.

    Re the phone calls: when I moved I changed my mobile to PAYG and HSBC haven't got my new number. I make all calls from my work phone, so that they won't get caller ID and harrass me. You're right about the call-centres though - so frustrating!! I keep in touch with them regularly by phone and letter, so it's not like I'm ignoring them.

  • Thanks for all the advice, i'll let u know how i get on.

    With regards Payplan. Took the morning off work to ring them bang on opening time at 9am, guess what all the advisors where busy! Managed to finally get thro to a Payplan operator who said my case officer would call me back within the hour. Needless to say no-one rang at anytime that day.

    Think i might have been better going with CCCS or Myvesta in the first place.
