Need HELP! Settlements , defaults and template letters

Hi i need help, ive read through so many posts on here and they are full of really useful info, but im also confused with it all :o.
Since 2006 i have been on a DMP and have just partial settled with them all. Most of the creditors defaulted me in 2007, when i started my DMP which i fully understand due to me paying reduced payments. After sending out mt partial settlements via payplan i have obtained my credit report and have discovered that after being on a DMP for nearly 7 years
Lloyds TSB only defaulted me on 28/06/2012
freemans catologue defaulted me on 11/07/2011
Robinsonway defaulted me on 11/06/2008
Cabot defaulted me on 21/12/2008
this means that my credit status has been rubbish for the past 7 years ( which i understand ias i was on DMP) But its also going to be bad for another 6 years because of these late defaults.
Is there anyway of having them removed or the dates altered to when i originally defaulted at the start of my DMP.
All help is greatly appreciated as i am confused as to which letter templates i should use

  • Google 'ICO Default guidelines' and that will tell you when defaults should be applied.

    Depends on the level of DMP payments I think.

    Once you have digested the document, you might want to complain to the companies to get them moved.

  • hi many thanks for the response, having looked at the ICO guidelines as far as i can tell all the companies should have defaulted me within six months of me starting my DMP as this is when i defaulted on my min monthly payments with them. im just having trouble putting it into a letter?? ive seen templates on here but not sure which one best suits these circumstances?
  • Don't think you need a template. Just quote the facts ask them to change it as per guidelines.

    You can refer to FOS if they refuse to play ball.

  • this is what i have written so far, thoughts please :
    Dear Sir / Madam:

    I Have just obtained a copy of my creditreport, and it has come to my attention that you have issued a default to me onthe 28/06/2012.

    I believe that the date of default on the above account is incorrect. Havingobtained some advice, I was advised that a defaultshould be issued 6 months after an account goes into arrears or is under paid.I believe you took longer than the 6 month time frame to issue my default, and I had already began a repayment plan over6 years before the default was issued. I startedmy Debt Management plan in January 2006 with yourself and other creditors through a company called Payplan towhich I have never missed or been late with any payments arranged. My othercreditors on the DMP defaulted me in 2007 in accordance with ICO guidelines. I quote the ICO guidance that says that a debtor who is making aneffort to pay should not be placed in a worse position that someone who hasmade no effort to repay at all. In Defaulting me this late into my DMP you aretherefore putting me in a worse position for just over 12 years.

    I would like to have this default removed as soonas possible as I believe you have not followed the correct procedure and it isnow having a detrimental effect on my financial status.


    I request that the date on the default is amended accordingly as soon as possible,showing the true date of the default, meaning itwill now be removed from my credit report.
  • I would remove the second last bit about removing the default, as its factual so should not be removed.

    In the last bit, just drop the 'meaning it will be removed from my credit report' as its not really needed.

    As long as the DMP payments to them didn't n significantly change at the date they applied he default I would think you have a good case.

    Remember to send signed for.
