CapQuest

Hi All,

just a quick question on behalf of my daughter. We have requested certain documentation from CapQuest, in their last letter received they state that CapQuest has requested the documentation as stated in her letter and the above referenced account has been placed on hold. However in order for CapQuest to supply her with all the relevant documentation relating to the above account and security purposes please confirm if you have ever formally resided at an address in
.

It's a long story going on a number of years, but I would like to know do we have to confirm whether she ever resided there or not?

  • to be honest no, i wouldn't supply any details, there basically fishing for information, if they are going to chase a debt they must have all the details their infront of them,but im sure someone with a lot more knowledge will be along shortly to give you some sound advice

  • Thanks for your reply, I was wondering were she stood legally as to whether she had to supply the imformation or not.
  • Legally you have to do nothing. It's up to them to prove who owes them money, where they live and that they have the correct person. The only time you need to do anything is if you receive court papers.

    what are you asking them for
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    We are asking them for
    1. A true copy of the agreement they refer to and said this is her right under your obligation to supply a copy of the agreement the legislation contained within s.78(1) Consumer Credit Act 1974(s.77(1) for fixed sum credit)-your obligation also extends to providing a statement of account. I enclose £1 in payment of the statutory fee.
    2. A signed true copy of the deed of assignment of the above referenced agreement you allege exists.
    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCa 1974.

    There is a lot more to the letter, I don't know if this is out of date now as the original was first sent at the end of 2008.
