CCA Procedure

Hi

I just want to learn the procedure to writing off to a company requesting your CCA.

Ok, so i print off and sign the standard letter, and enclose a cheque for 1 pound (can i send something else, seeing as i dont have a cheque book?).

They then have 12 days to send me the CCA, and after 30 days they commit an offense when they pursue the debt.

Ok, so lets say they cannot provide me with a CCA, but a default remains on my credit file, what do i do? Do i ring Equifax and ask them to remove the entry/default from my file? Will they remove it?

As im sure the DCA wont be in any hurry to remove a default entry from my file.

Is this the procedure?

    I'm not quite sure about removing the default but you can ask for nothing. You can send a postal order for the £1 fee.

    As far as I aware, after the 12 plus 30 days they have committed an offence by not supplying you with the CCA and therefore cannot not continue to chase you for the debt until they supply a CCA. If at any time after the 12 plus 30 days they produce the CCA the debt then becomes enforcable again. After you have sent the CCA request and until they provide the CCA, they cannot chase you for payment or contact you in any way unless its to provide you with a CCA.
