Consumer Credit Act 1974 - now what...!?!?!

I'll keep it brief - but feel free to ask for more info/company names etc if need be...!
I have taken over sorting out my fathers finances as he is being harassed continually by several credit companies throughout the day and into the late evening with incessant phonecalls etc.
I dug out the letter asking for copies of the original credit agreement quoting the CCA 1974 and telling several of these companies (Moorcroft etc) that they would be committing a Criminal Offence if they did not comply.
I also sent them all cheques for £1 - all of which have been cashed - some of which have been credited to the accounts... lol
Since then - nothing. I shouted at one guy on the phone and told him I was also recording the call (at which he didn't want to talk to me anymore...) :rolleyes: and now the same old letters have started turning up for my old dad - you haven't paid us - please pay.
Some of these debts are over 10 years old - (when my mother upped and left and dumped him right in it) and I just KNOW they haven't a clue where the original paperwork is.
The only problem is - now what? I just love taking over the call on my dads behalf (he's 63) and giving them a piece of my mind - let alone quoting acts and sections that they have no knowledge about - I just want the next string to my bow - who can I actually report these people to?

if the debts are over six years old and there has been no acknowledgement by your fathers during that time (i.e. he hasn't paid anything or written offering to) then the debts are statute barred. So it would be better for your father to use this avenue rather than the CCA.0

No, sadly they've been on at him the whole time - he's been paying about a pound a month on a lot of them - which is pretty pointless. Any other advice guys??
I read of people printing out this template and sending it off the wholetime - but no-one seems to have said what the follow up action is....?
Advice greatly appreciated."Only the dead have seen the end of war" - Plato :silenced:0 -
I'd certainly try and get the companies phone numbers barred from your father's phone so they can't upset him.0

go to the website https://www.consumeractiongroup.co.uk. There is a lot of info on this kind of thing, and you can glean information about specific companies like Moorcroft.
Do what the previous poster says and barr the numbers, you can do it through bt and ONLY correspond with these companies via letter, preferably recorded delivery.
Also go to https://www.experian.co.uk and take out a free trial and request a copy of your dad's credit file. It will show you what info is on your dad and what you are actually dealing with.Quality is doing something right when no one is looking - Henry Ford

Hi, Im not sure what letter template letter you sent but normally it would say that that you will report them to the financial ombudsman and the office of fair trading. Im not sure what other regulators there are.
Have you sent a follow up letter saying that as they have been unable to provide you with the the CCA within the time period giving that you assume that is the end of the matter and if not then you will be reprting them to the "regulators". It may be worth trying to call there bluff.Official DFW Nerd Club - Member no. 297 - Proud To Be Dealing With My Debts0 -
This factsheet gives details of what you can do when suffering 'harassment' by creditors.
http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=03_harassment
It includes:Harassment of people in debt by creditors or their agents is a criminal offence under the Administration of Justice Act 1970. It is often difficult to know what to do when you feel a creditor is not dealing with your account fairly. In order for you to identify what activities by your creditors may involve harassment and what can be done about the problem, this fact sheet outlines:
* the relevant section of the Administration of Justice Act;
* the Office of Fair Trading (OFT) Debt Collection Guidance on harassment;
* how to deal with harassment by your creditors
Under the Consumer Credit Act 2006, companies with a consumer credit license are also regulated by the Financial Ombudsman.

Super muchos gracias senora/ita(s)!!
I do like nothing more than having a good bash at these debt companies - after getting them to call me back first of all....
You should all try it sometime - it relieves tension from road rage/stress/helps me sleep better at night.
I'll let you all know how I get on.
Thanks again!!"Only the dead have seen the end of war" - Plato :silenced:0
