Incorrect Tax Adjustment this Month's Wages

New here - wondered if anybody can help.

My husband started his new job on May 3rd 2012. He handed in his P45 which correctly covered 1st April ~ 2nd May 2012 to his new employer, and everything has been fine until today.

The amount shown on the P45 from his previous employer was correct in relation to amounts on pay slips and total paid into his account.

He gets his wages paid on the last Friday of every month - and within a few pennies, it's always the same amount.

Checked this morning, and his wages are over £600 short compared to normal.

According to his employer, HMRC contacted them to say earnings from April 1st 2012 to 2rd may 2012, (while in his old job) were £4520, therefore he has underpaid tax and an adjustment was issued - resulting in the £600 shortage .....

Phoned HMRC to ask where they got the £4520 figure from - as it's very very wrong - his P45, and bank statements show his earnings for that period to be £3k less than this....

Long story short - HMRC standing by the "He earn't £4250"
I say "No he didn't - I have the bank statements / P45 / Wage slips etc to prove this"

Without going into too much detail - On the 1st our Rent / Bills etc are due, and we don't have enough to cover them - we are sadly in a horrendous financial position (I lost my job) so are very much hand to mouth living at the moment - this is possibly the last straw...

Advice on what to do please - Thanks in advance

  • How long had he worked for the previous employer?

    Did he receive any additional payments on top of what was on the p45, holiday pay, redundancy pay off etc?

    You say tax office are standing by the 4250, did they explain where they got this figure from?

    Your husband should have part 1 of his P45 from the old employer showing the correct pay and tax details. Give that to HMRC as proof of his actual income.

    He received no holiday or other pay on top of normal wages...

    It was a simple case of handing in notice and moving to another job down the road....

    HMRC are adamant the figure is what was input from the P45 they received - However when I asked them to check the copy scanned onto the system, they don't have it to look at - only the data input from the P45....

    I argued that whoever "input" the data got the figure wrong - it's wrong by one digit - HMRC say 4520 - Copy here in front of me for P45 shows 1520., nope they wouldn't budge....

    I've finally got the HMRC to agree to trace the "original" P45 and check it ... They have informed me they have 3 weeks to trace it, although they can apply to have longer...

    I have checked with Current employer who have a copy of their part of the P45 and its obviously the same figure as Hubby's.

    All in all - judging from the tone of call with HMRC, this could go on for weeks if not months....
  • I offered to pop into Tax office or Fax Hubby's Part 1A, wage slips, bank statements everything - apparently they will NOT take that - as it "might not be real" they have to trace "their" copy.

    You could always send a copy of your copy of the P45.

    EDIT - cross posted with your post saying they won't accept it.

    One thing I would query is whether the P45 was sent in on paper to HMRC and so processed by them or if it was sent electronically by the previous employer in which case it may have been they who keyed in the wrong figure.

    If you don't want to wait for HMRC to try to trace a paper P45 get your husband to get to his nearest HMRC enquiry centre and ask them to correct the record. He might have to make an appointment depending on how busy they are but get him to take 2 forms of ID (photographic and proof of address) in case they can fit him in on the day. Obviously take the P45 too

    When I offered to pop into local office I told them Hubby would be the one going - along with me !!

    I would still suggest going down to the tax office. Mainly because if they check and see that HMRC did process the P45 themselves lodging an official complaint might get the case resolved more quickly.
