Equifax wont change status of Bankruptcy

Hi all just a quick question. I am trying to get Equifax to update my credit file to show that my bankruptcy was discharged in 2009, it currently says active. I have provided them with a signed letter from the insolvency service as proof. However they have said that they need a copy of my discharge certificate to prove this which will cost me £75 with the courts. Anyone had a similar experience. I would have thought that proof I was discharged was enough.

Experian have been able to put the correct date of discharge so why cant Equifax. Could I use my Experian file as proof also?

    Well, tell Equifax that you have given them more than sufficient proof of the discharge, and consequently they are now in breach of their duties under the DPA.

    State that if they do not correct your file then you will be taking the matter to the FOS and ICO.

  • When you call them ask to speak to someone from the UK.
    I had success by doing that .
  • Hi all, I'm having issues with Equifax too. I have 2 defaults that have not been updated since 2009 even though the lenders say they have reverted to Equifax saying they are satisfied. I have sent Equifax proof of discharge, copies of my Experian file that shows 'satisfied' and raised disputes via their on-line facility. I suppose the next step is the ICO.

    Well 2 days later and still no joy, fsa can’t help, ombudsmen cant help, information commissioner can’t help. :( What now?

    Tried ringing Equifax again and got no where with the foreign call handler. I don’t think they have a clue some times, when they spend 5 mins trying to get your name right, you just know its gona be a long call....:p

    I asked to speak to some one in the UK and was told they are to busy and I would get a call back during the week..... I won’t hold my breath. Looks like I might have to pay for the discharge certificate, even though I think any reasonable person would agree that my evidence is sound......

    You say ICO cant help but have you raised a complaint as it can take up to a year to resolve depending on ICO workload, but you will get somewhere if you complain, if you want this sorted and dont want to pay then the ICO is the route to go.

    When i was discharged neither of the 3 CRA's would accept anything other then the discharge certificate. When i was discharged i used this cert soooo many times, you can't not get a copy for your records. Believe me you'll be happier and everything will go much quicker mate. Although it was 2009 when you was discharged so i'm sure you "did" have a copy before didn't you?

    never did get a copy of my discharge certificate. the guy in belfast high court told me its not something that just gets sent out, you have to apply for it.

    regarding the ico and making a complaint. the girl i spoke too said that i could lodge a complaint, but even if they found in my favour, their ruling is not enforceable with the credit referance agencies. :cool:

    Yeah its the same for everyone, everyone needs to apply for it at the court they used then pay a fee.

    After a strongly worded reply to equifax they have marked my bankruptcy as discharged. so credit where credits due :p ,and i have saved myself £75. cheers for all the replys
