Employer failed to setup PAYE then sacked me?

I worked for a company for just over 4 months. They said they were expanding and had never setup PAYE before and to bear with them. I saw that they also had other problems with moving units and the likes so I understood that things might be slow but did say it would be sorted.

I was given what I would have taken home after tax in order for them to easily catch up with deductions when they got sorted.

Eventually I was told they couldn't afford to pay me and I had to leave.

I was still owed some wages for which I have stared a procedure with acas. I should hear from them tomorrow and can ask them too but...

My brother pointed out that if I was under the tax thresh hold for the year coming to a close I would get a rebate. I am way under the thresh hold but my ex-employer never sorted the tax an NI. When I asked them about it before I left they said, don't say anything it won't matter.

I have not had much luck finding a new job and didn't realise I was entitled to a rebate before but could really do with it? It works out as 833 he never paid to hmrc.

There seem's to be so much confusion about who is liable for tax that it worries me. I am not registered self employed and asked this employer to sort things out nearly every week...


Am I right in thinking I should be reporting him, for one anyway, and that I would be able to get this back as a rebate?

    Report it to HMRC now and they may be able to enforce payment of the tax and NI that the employer was due to pay before the end of the tax year, which would hopefully enable your refund to be processed fairly easily. Even if they don't get the money out of the employer it's still their responsibility to pay it, having collected it from their employees, so you should still be able to reclaim the overpayment, although you might have to register for Self Assessment and complete a return.
