bankruptcy and property

My ex husband recently went bankrupt (before out financial settlement) and has left a huge mess to sort out. Through his trustees, I bought his beneficial interest and equitable interest in 3 properties, have had the title deeds changed but cannot get the land registry changed due to restrictions from my ex's current bank lenders.

Due to my financial circumstances, I can only 'assume' the mortgages.

I have arrears to pay off on all the properties and need to get vacant posseession on one of the properties, which is where my ex lives.

If I can get him out of the house, I can secure a sale on that property and pay off a load of his debt (company, also left to me).

If I can get information regarding the arrears from the current lenders, I can repay them and secure another two homes for tenants.

My ex is absolutely no way going to help and it looks like the courts will have to get involved.

I wonder how it will all work out?

Does anyone know how to get info from lenders when your name is not on the mortgage and have any idea how to get vacant possession on that property bearing in mind I have already paid for the houses from the trustees in my ex husbands bankruptcy!!!!

    Have you paid off the mortgages on these properties ?

    If not then you will have bought the beneficial interest from the OR (ie any equity in them).

    I don't know of any way that you can force the banks to tell you the arrears, indeed if they did without the debtors agreement then they would be in breach of the DPA.

    The only way that you can get vacant posession of a property if the tenent is unco-operative is to legally evict them.

    Whether this is possible to do to your ex (as he is (I assume) still on the mortgage I don't have a clue and will leave that for someone who knows to advise
  • No I have not paid off the mortgages but have secured a sale on the main proeprty which is why I need vacant possession. I think I can go to court to get a possession order 1 year after my ex's bankruptcy. I hope so any way!!!!
