Even £52 a week in JSA is worth claiming. Also, don't forget that as well as JSA, your stamp will continue to be paid which could be crucial if you need to claim benefits within the next 2 years or so.

The terms and conditions of the credit card allow then to assign the debt to a third party, and if they do then the debtor then legally owes the debt collection agency. They are required to provide a notice of assignment from the original creditor and should supply a copy of the credit agreement if the debtor makes such a request, but thet have a right to collect the debt and if a debtor refused to pay could commence court action

The debtor is in discussion with the lender. No communication is required with a dca and the lender should not have passed the debt on. Write the letter maybe add that you're in discussion with the original lender then sit back and let them threaten all they want, it won't go to court. Contact the lender and tell them that due to financial difficulty you can't afford to pay. That should take a couple of weeks, during which time you can do the most important thing and sort your benefit, and sit back, chill and check the sites.

  • I finally got a jsa payment today :)

I wrote the letter and told them my circumstances should be better in 6 months time and to get back in touch with me then. I also quoted the stay away letter to make sure I don't get any visits. It seemed the best thing to do.

I'm going to talk to my partner tonight, I hope he's understanding about it.

I'm feeling much better now I've actually done something about it. On the business front, I just got a lot of free material so I'm making stock for my stall.

I would be interested to know how to go about claiming work tax credits and also how to claim the missed weeks of JSA if anyone can help??

    Feeling better xx

The dca will send letters to you now threatening court and additional charges, but they can be dealt with as you get them, just remember they are in the business of trying to get money off you anyway they can but they have to stay within the law...you can dispute the fact that you owe them anything but that's for later.
I would write to the original lender and say you want to discuss the debt, that way you're in discussion with them and can ignore the dca.
You might be well advised to visit a cab with regards to benefit and tax credits, but surely a quick call to the benefit office or tax office would do?
It's good you're feeling better, facing up to these things is always the best way. well done.
