default X2 for same loan

hi there my partner had an account (loan) set to default in 2006 which i understand stays on his credit report 6 years from date set to default he has been paying this off and had a small amount left but the minute this default was due to come off (2012) they set the account to default again can you get X2 defaults for the same loan it has been fully paid now. will this now stay on his report for 6 years?

    No...you cannot, you should contact lender & make formal written complaint and take your case to Financial Ombnusman if not resolved...

    just to add he never got an letters from the "lenders" to warn him off any default action for the 2nd default

    It wouldn't have mattered if he'd had loads of letters. You simply cannot default on a loan twice.
  • Debt Collection Agencies tend to do this so you contact them and they try and get you to pay.

    Who owns the account, I.e who updated the credit report?

    As said before, written complaint and insist its removed.

    thanks for your help and advice it was BLACK HORSE that have set both defaults on the same loan.
    So from the answers i am getting here they should not have done this.
    I have also heard that they must inform you if they plan to set default on your report he never got any warning of this eithier
    Would calling them help or should I just write.
    All money due has now been fully repaid but because of a mistake years ago its still affecting him now.

  • Complaint in writing, signed for, harder to ignore. Ask for removal and compensation especially if now only problem on credit report thus preventing credit.

    No joy after 8 weeks refer to FOS.

    Just an update today he rang the FOS who were great the have now sent a letter to the "lenders" on his behalf and said he does have a case and that they were wrong to put this default on

    Hi guys
    Glad to be able to give another update so fast. The default has now been completely REMOVED from his file and it should NEVER have been on it in the first place. But he would never have known it was there, if I he had not checked his credit report.
    Thanks for all your help on this as we were unsure where to start.
    Now I can get things moving so we can get on the property ladder.

    Hopefully this infromation can help other prople in the same boat.
