    They have admitted that it was deliverd to me in error.

    Well then whats the problem?
    Tell them in no uncertain terms to get it out asap!
    You didn`t order it, you don`t want it, why should your back garden tank now become a mini storage facility for their oil?!

  • After speaking to them at length yesterday evening their senior credit controller told me that they have a copy of an unsigned delivery docket and notes on the file stating that I have spoken to them ! I really do not know what to do. They have admitted that it was deliverd to me in error.

    Stop panicking and letting them intimidate you for starters. Google Unsolicited Goods and pick the one on the Citizens Advice page.

    You did not order this. It's their responsibility. Tell them to come and get it back. There are letters on the CAB page you can use. Please also tell them you will be reporting them to Trading Standards for trying to force you to pay for unsolicitated goods.

    From what I've read, if the oil company refused to remove the oil although you told them that you didn't want it then I think you have a case for non-payment.
    If you accepted the oil in any way (including not insisting that they remove it) once it was delivered then you are liable for payment. You don't have the right to keep it for free even though it was their mistake.
    It may be worth ringing them and coming to some arrangement where you get it at a good price. It'll cost them to take you to court.
    If you go to court make sure you have evidence that you asked them to remove it and they did not do this.

    I think this is the best advice you have gotten here. It might be worth going around to the office yourself giving them a sum that you are happy with. You might end up getting some very cheap oil.

    I would settle it quickly as the law may be on their side with regard to you accpeting it especially if you are presently using it.
  • I doubt the law is on their side - what if they'd filled the tank?! Hundreds and hundreds of quids worth? What's to stop them driving round the country randomly filling people's tanks then charging them for it?

    It's an unsolicitited delivery. The OP has to give them the chance to take it back or else he can claim it as his own. At which point the company should be offering him a very cheap price to keep it.

    This happened to us a couple of years back. I thought OH had ordered oil and just forgot to tell me. I went out and opened oil tank. Oil was actually for my neighbour/house next door.
    We began to negotiate with them (we would 've need oil soon anyway). We told the oil company that we normally use a different supplier (we use just whoever is the cheapest when ordering) and that we could've got it cheaper elsewhere. They said they would reduce/ match the lowest price and then knock a few more £'s off (ended up with quite a good price). We then said as it was coming up to xmas we didn't have the money (true) and could we pay it off monthly. They said they would wait until April for the payment.
    In the end we ended up better off - Oil at a cheaper price.
    As for yourselves, as you use oil anyway, I would suggest talking to supplier and ask him to reduce price - to a reasonable amount, and ask for 6 months to pay it off. In this weather you need your heating so you will use it. Don't waste time arguing and getting all worked up. Talk to the supplier and work something out between yourselves. Don't just speak to the girls on the desk that take the orders, talk to the owner/manager. Turn this to your advantage and get cheap oil.
