Sport Aberdeen Contract Change to T&C'S

Hi,

Was wondering if some professionals could give me some advice here..

I work with Sport Aberdeen, they are currently trying change all shift workers T&C's to save money for the company and to hire a new management team.

They have issued our 90 day notice and have been in consultation with the trade unions for this time. The formal 90 day notice came to a close on the '14th Jan 2013'. One Union has accepted and two have not.

I am not in a union.

We have all received letters now asking us if we agree with the new T&C's. Two forms, one green and one yellow which are identical apart from the 'I AGREE' or 'I DON'T AGREE' with a space at the bottom for us to sign and return.

What I don't understand is why are they giving us this choice ? I was under the impression that if a company wanted to change your contract they could after the notice was up ?

If I didn't reply to the letter but continued to attend work would this legally be deemed as me having accepted the new T&C's ?
