What is the maxmium amount of contracted working hours allowed in the UK?

Hi all,

I work within a contact centre, and currently work a total of 45 hours a week though I am contracted to work 37.5. Normally if I was to take a days as holiday I would have been paid for the full 9 hours I do per day though changes have now been made so I will now only be paid for 7.5 when taking holiday as the remanding amount of 1.5 hours is now considered 'over time'. Would it be possible to increase my contract to 45 hours, so that I can take full advantage of holiday pay?

Additional information: I don't get paid any more than normal for 'over time'.

    That wouldn't legally be a problem - you wouldn't even have to sign a waiver for the Working Time Regulations (48hrs a week) and as long as your shifts are 11hrs apart and you get one day off out of each 7 then its legal.

    The question is whether your employer would want to do that - and they have to be in agreement with it to make the change to the contract.

    I suspect since they are making these changes that take holiday pay to be 7.5hrs instead of 9 that they won't!
  • I think most overtime is like the equliavent of the Nationwide advert on savings interest in that they keep what we would get in extra holiday pay as a 'bonus', unless your an agency as i've usually been paid it when working for an agency.
