Year contract as Apprentice but being made redundant?

My son has been employed since November for an independant electrical retailer as a level 2 retail apprentice, which is due to finish in October. He always knew he wouldn't be kept beyond that date.

He has worked really hard and is slightly ahead in the college work (NVQ) for the official qualification.

However he had just come home and apparently his boss (shop owner) has said he can't afford him (on£2.50/hour!) and he is going to be made redundant in March!! So what happens with the qualification. Has this all just been a waste of time? He turned down another job recently on proper minimum wage because he wanted this NVQ!!

He's been regularly making daily sales of up to £3000, which is a flipping miracle these days. Even talked my OH into buying a new built in fridge freezer instead of a repair, so I know he's good at sales.

I am just so mad! Is there anything we can do ( well him, but with me assisting as he's only 17)! I thought companies got a subsidy to pay for apprentices like when they employed YTS trainees.

    He has someone from the college pop in and observe once in a while but that's it's. It's a very small operation, with the business owner, 2 other sales staff and an installation engineer.

    That's been replaced by http://www.legislation.gov.uk/uksi/2012/1199/made in Nov 12. So hopefully he can finish it as he's been there 69 months by the time he has to leave, either that or the provider has to provide an alternative employer(if I'm reading it right)

  • He needs to speak to his apprentice co-ordinator (the one who pops in) as the college (provider) should help him find another placement in order to finish his NVQ.
  • Depending on the type of contract he has been issued the organisation may not be able to make him redundant. If the wrong type of contract has been issued you can pursue in an employment tribunal for breach of contract claiming loss of earnings and loss of future earnings because his apprenticeship has been cut short.
  • Saintjimmywine will be able to confirm this but I have just read next year's SFA funding rules - specifically the Apprenticeship section and paragraph 115 states that under certain circumstances, apprentices do not need to be employed under an apprenticeship agreement. 115.1 states that... Apprentices who are made redundant through no fault of their own, up to six months before completing their Apprenticeship.

    I would interpret that to mean that he can still complete the education element with the college and/or Learning Provider?

    Edit. Sorry just realised that this would be from August. Not sure if it is in place in 2012/13 (Saintjimmywine?) but would be worth asking.

    What the hell is he supposed to live on? I'm on long term sick(cancer) and can't afford to subsidise him. His keep was paying for groceries etc. Gahhh!

    Couldn't he go back into education, perhaps look at one of the Prince's Trust courses?
