Former employer seeking overpaid wages??

So I got a letter in the post saying that I owe my previous employer £115.17 as an over-payment.

I find this odd because when I received my P60 from them my pay was actually 0.00

I've attached the P60 with all the important bits blocked out but you can see there is a figure there for £115.17 and I have £50.00 sharesave which leaves £65.17 that they should have paid me - but they didn't - or am I reading it wrong?

The image that you have here is not a P60 it is a payslip and that confirms that £115.17 was paid to you, though the payment was then cancelled out apparently by a deduction and a reversal of holiday pay. I would suggest contacting your old employer for a full explanation of why they feel you owe them money. Regarding the holiday pay did you take more holiday than you were entitled to for length of time you were there for the holiday year?
  • Thanks I thought I was reading it correct.

The holidays are all managed on their end via a system they use. I only took about two days off in total which the manager arranged so I didn't have to work my notice and could leave.

So I got in contact with them and after about a month or they have come back to me and said that it was down to a contribution to my sharesave (which is fair enough, that accounts for the £50) and the £65 was because I took holidays I was not entitled to.

However this was when I was leaving the company and I said to the manager when I gave my notice, I realise I have 4 weeks to work but is there any way I can get out earlier to start my new job.

The manager said to me "Work your contracted hours for the next week and then we'll leave it there"

They wrote on the letter that "as a term of your employment any loans or overpayments in respect to any holidays taken in excess of entitlements, or any other amounts owing to us we bill deducted from your final pay, where the amounts due to us exceed any amount due to you it is a term of your employment that you will need to pay back the balance immediately."

My main issues with this are
    1) I never requested any holiday time from the manager, in my old branch we had holiday requests forms I never signed on at the new branch since I never took a holiday there

    2) I don't recall (along with other people I know) ever signing any contract of employment - could I ask for my copy of the contract and if they can't provide it then they can't enforce it?

I left for a job with a small company that went unexpectedly bust so can't really afford £115 at this moment.

Yes it is the one before that I would like to see. The payslip you have shows a reduction for holiday but cannot tell if this is reflected in cumulative figures. Did you not get regular payslips, if so it would be interesting to see any one of these, latest that you have, to see what details they have on them.

Just a quick comment to mention that you should be able to set up a payment plan with the company, so you probably wouldn't need to pay the full amount back all at once. But obviously, try to get to the bottom of this first.
