Housing Benefit Not included in DRO

My nephew worked and claimed HB.
He acquired a DRO but the amount that the HB came to has to be paid back in full because it was classed as fraudulant.
Therefore could not be added to his debts in the DRO.
Is this correct? Does anyone know if things have changed since Feb 2012 when he got this done.
He is currently having to pay back over £2000 to Housing Benefit and he is struggling now that all his benefits have stopped.

Why have the benefits stopped? Having a previous fraudulent claim does not stop him from claiming again now or in the future. If he has an income then he has money to pay the council back. They have a fixed percentage they can take from his pay which is reasonably low and he has to live on the rest.:footie:
