I can feel one brewing as well Jock, so if you don't I won't either.

How about, it's failed it's MOT Test? "Mums Old Tram" so I've completed my SORN "Scrap Only Reserve Nothing" and therefore it's not worth selling.

PS: If you're really convincing DM you might even persuade the O.R to pay for any necessary repairs and charge it to your creditors :rotfl:

    Sorry Jock

We have a motability car,and the OR had no interest in it.As for not using it for work I am a bit confused. The car is for the benefit of your daughter,so using it for work I would have thought comes in to that category?
As for other vehicles,I have an old motorbike that is worth about £100.The OR accepted £50 to buy out their interest in it,but I think I could have got it cheaper if I had 'haggled',but that would be a 'worse case scenario' for you.If you are not allowed to use the mobility car, then you obviously need the other one for work, and the OR should not touch it.
  • ok ... if they say i have to buy it back how do i do that with no spare money ??? any ideas ....do they let you pay them so much a week ?

Very good question as surely if you pay them ANYTHING for stuff such as a car you are all but admitting that your SOA is false and that you actually have spare cash? Plus I know we wouldn't be able to get the cash together at all (as SOA is pretty accurate).

I would strongly suggest taking someone along for moral support, goodness only knows who we'll bring along if we have a face to face but there you go...

As has been posted... you need the car, it is cheap, you can't legally use the other car.

End of story (he says not having to go through it all yet himself).

Good luck and loads of hugs from us!

    Desperate mum,

The O.R will not deprive a bankrupt of the means to earn a living, if you need your car for work I'm convinced you'll get to keep it. We managed to keep two vehicles and didn't really have to try very hard to make a convincing argument.

In the unlikely event that they do take it, the correct procedure is for a third party, friend or relative, to either make an offer or purchase the item at auction. In the few cases where this has happened the item has been purchased at a greatly reduced discount to it's supposed valuation. There would be nothing wrong with asking a friend or relative to buy it and then repaying them over a period of time.

See what they have to say about it, DM, then let us know. I wonder if the OR mis-read what you put - if it's only worth £300, it would cost them not far off that to get it sold. Print off the info from Fermi, anything you can get from Motability as well as from the Insolvency site & def take someone with you if you can. I don't think it will, but if it comes to it, I'd be willing to chip in with a contribution - won't be much, but every little helps. :)

Hi DM - I hope that the OR does not take your car - there is, or certainly appears to be, a lot of inconsistency on the way that individual ORs handle that question. As previously posted, I would be quite surprised if you were not allowed to keep the car, but, in the possible event that OR does decide to deprive you of the means of earning your living, please inform the OR that you disagree with that particular decision and ask about the procedure for appeal. The OR is obliged to listen, and must inform you of any appeals/complaints procedures.
In saying that, though, most people, including myself, have found the OR to be both sympathetic, to reason, and helpfull.
