Workfare illegal? Apparently...

Just heard this on the radio...will be interesting to see how the Government react to this judgement.

  • Sounds good, until you read this: newstatesman.com/politics/2013/02/workfare-ruled-illegal-only-narrow-terms The DWP only need to tell you that you have the option of refusing, and that if you refuse, you will lose your benefits for six months, so the Workfare scheme will continue.
  • Plus, they are usually only mandatory once the candidate has agreed to attend voluntarily. Sounds a little odd but it means that the candidate can opt out right up to the start of the training (including 2 induction sessions) before they can be sanctioned.

    It was only ruled illegal based on them not following some technicalities in the legislation correctly; once they amend the system to get around that then there is no problem as far as the courts were concerned.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
